Özet
Bir çocuk, ona rehberlik edecek ebeveynlerinin eşliğinde ve güven dolu bir ortamda kendi benlik algısını geliştirir. Çocuğun benliği, kendisi için önem taşıyan ana ve babasının ona gösterdiği tutumların bir yansımasıdır. Bu sebeple, ana ve babadan gelen olumsuz tutumlar çocuğun kendini değersiz bulması ile sonuçlanır ve bu değersizlik duygusu, yaşamı boyunca çocuğu takip eder. Ana babanın bu olumsuz tutumlarının altında başkaca hangi neden yatıyor olursa olsun; temelde çocuğun ayrı, biricik ve özerk bir varlık olarak kabul görmemesi ana sebeptir. İşte, bu çalışma çocukların hukuk sistemi içerisinde nasıl daha fazla özerklik kazanabilecekleri ve aile içinde gelişimlerini olumsuz etkileyebilecek olgulardan nasıl korunabilecekleri sorularına yanıt aramaktadır. Çalışmanın ilk bölümü, hukukta çocuk dendiğinde akla ilk gelen kavramların açıklanmasına ayrılmış ve bu kavramlar, çocuğu merkeze alarak yorumlanmıştır. Çalışmanın ikinci bölümü ise özellikle Türk Medeni Kanunu m. 346-351 hükümleri çerçevesinde çocuğun kişi varlığının korunmasına ayrılmıştır.
Özet (Çeviri)
A child develops his/her sense of self in an environment of trust and in the company of parents who guide him/her. A child's sense of self is a reflection of the attitudes of the parents who are important to him/her. Therefore, negative attitudes from parents result in the child feeling worthless and this feeling of worthlessness follows the child throughout his/her life. Whatever other reasons may underlie these negative attitudes of the parents, the main reason is that the child is not recognized as a separate, unique and autonomous being. This study seeks answers to the questions of how children can gain more autonomy within the legal system and how they can be protected from phenomena that may negatively affect their development within the family. The first part of the study is devoted to the explanation of the first concepts that come to mind when the child is mentioned in law and these concepts are interpreted by putting the child at the center. The second part of the study is devoted to the protection of the personal existence of the child, especially within the framework of articles 346-351 of the Turkish Civil Code.
