Özet
Bu çalışmanın konusu boşanma sürecinde çocuk haklarının korunmasıdır. Çalışmaya konu edilen boşanma davaları, uygulamada bilinen adıyla çekişmeli boşanma davalarıdır. Çalışma süreç odaklı olup boşanma davası sonucunda çocuğa ilişkin olarak verilecek nihai kararlar bu çalışmanın kapsamı dışındadır. Çalışma üç bölümde ele alınmıştır. Birinci bölümde çocuk ve çocuğun üstün yararı ilkesi; ikinci bölümde boşanma sürecinde çocuğun hukuki konumu, gözetilmesi, geçici velayet, kişisel ilişki ve tedbir nafakası; üçüncü bölümde boşanma sürecinde çocuğun kişilik hakkı, katılma hakkı ve çocuk malları konuları incelenmiştir. Çocuğu koruma ve gözetme yükümlülüğü kural olarak öncelikle çocuğun annesi ve babasına aittir. Ancak boşanma davası açılmakla hâkimin de bu konuda sorumluluğu doğmaktadır. Hâkimin çocukla ilgili görev ve yetkisi geçici velayet, kişisel ilişki ve tedbir nafakası hususlarında karar vermekle sınırlı değildir. Bununla birlikte çocuğun kişilik hakkının ve mal varlığının korunması da boşanma davası süresince hâkimin sorumluluk alanlarından birini oluşturmaktadır. Tüm bu görevleri yerine getiren hâkim aynı zamanda çocuğun da sürece etkin katılımını sağlamalı, kendisini ilgilendiren konularda görüşlerini ifade etmesine imkân tanımalıdır.

The subject of this study is the protection of children's rights during the divorce process. The divorce cases subject to the study are contested divorce cases, as they are known in practice. The study is process-oriented and the final decisions regarding the child as a result of the divorce case are beyond the scope of this study. The study is discussed in three parts. In the first part, the child and the principle of the child's best interest; In the second part, the legal status of the child during the divorce process, temporary custody, personal relationship and temporary alimony; In the third part, the child's personal rights, participation rights and children's property issues during the divorce process are examined. As a rule, the obligation to protect and supervise the child primarily belongs to the child's mother and father. However, when a divorce case is sued, the judge also becomes responsible in this regard. The judge's duties and authority regarding the child are not limited to deciding on temporary custody, personal relationship and temporary alimony. In addition, protecting the child's personal rights and property is one of the areas of responsibility of the judge during the divorce case. The judge who fulfills all these duties must also ensure the active participation of the child in the process and allow her/him to express her/him views on issues that concern her.
