Özet
Bu çalışma kapsamında isimsiz bir sözleşme olan ve günümüzde tüm dünyada oldukça yaygın bir biçimde uygulanan franchise sözleşmesi hukuki açıdan ele alınmıştır. Çalışmanın birinci bölümünde öncelikle sözleşmenin tarihçesi ve kavramsal yapısı ele alınmıştır. Ardından ise franchise sözleşmesinin franchise verene, franchise alana ve topluma sağladığı faydalar ele alınarak sistemin risklerine de değinilmiştir. Yine aynı bölümün devamında sözleşmenin özelliklerinden ve türlerinden bahsedilmiştir. İkinci bölümde tarafların yükümlülükleri ele alınmış önce franchise verenin akabinde de franchise alanın sözleşme ile üstlendikleri yükümlülükleri sırası ile açıklanmıştır. Franchise sözleşmesi bünyesinde pek çok sözleşmeye ilişkin unsuru ihtiva etmesi nedeniyle birçok sözleşme ile benzer yanı mevcuttur. İş bu çalışmanın üçüncü bölümünde de franchise sözleşmesinin bu sözleşmeler ile benzer yanlarına değinilmiş ancak diğer yandan farklılıkları da ortaya konmuştur. Son olarak ise dördüncü bölümde sözleşmenin sona erme sebepleri ve sona ermesinin sonuçları açıklanmıştır.

In the scope of this study, franchise agreements which is still innominate contract in our legal system despite the common application of the agreement in the whole world, is reviewed from legal perspective. In the first chapter of this study; history and conceptual structure of the agreement are discussed. Then, the benefits of the franchise agreement to the franchisor, franchisee and society are discussed and the risks of the system are also mentioned. In the continuation of the same section, the characteristics and types of the contract are mentioned. In the second chapter, the obligations of the parties are discussed and the obligations of the franchisor and then of the franchisee are explained in order. Since the franchise agreement contains many diferent types of contractual elements, it is similar to many other agreements. In the third part of this study, the similarities of the franchise agreement with these agreements are mentioned, but on the other hand, their differences are also revealed. Finally, in the fourth section, the reasons for the termination of the contract and the consequences of its termination are explained.
