Özet
Çalışmamızın konusu gerek öğretide, gerekse yüksek mahkeme kararlarında tartışmaya yol açan bir konudur. Konuya ilişkin 2018 tarihinde Yargıtay İçtihadı Birleştirme Kararı verilmiştir. Fakat bu kararın gerekçesi ve karşı oyda açıklanan ifadeler tartışmaların devam etmesine sebep olmuştur. Tazminat sorumluluğunun incelenmesinden önce boşanma kavramı, sebepleri, zina kavramı ve içeriği hakkında ifadelere yer verilmesinin doğru olacağı düşüncesindeyiz. Birinci bölümde boşanma kavramı, genel ve özel boşanma sebepleri açıklanmıştır. İkinci bölümde ise özel boşanma sebeplerinden biri olan zina sebebiyle boşanma davası hakkında bilgi verilmiştir. Her ne kadar konumuz üçüncü kişinin tazminat sorumluluğu olsa da boşanma sebeplerinin neler olduğunu, zina sebebinin hangi kategoride sınıflandırıldığı hakkında açıklamalar yapılmasının uygun olacağını düşünmekteyiz. Üçüncü bölüm de ise zina sebebiyle boşanma davasında üçüncü kişinin tazminat sorumluğunun hangi şartlar altında bulunup bulunmadığı, Yargıtay, doktrinsel görüş ve katıldığımız görüş yer almaktadır. The subject of our study has caused considerable debate in both legal doctrine and in the decisions of the high judiciary. Regarding this issue, The Supreme Court's Decision to Unify Jurisprudence was rendered in 2018. However, the grounds of this decision, dissenting votes regarding the grounds and the statements made have not succeeded in resolving the disputes.Before examining the liability of compensation, it is necessary to provide statements about the concept of divorce, its grounds, the concept of adultery and its content. In the first chapter, the concept of divorce, general and specific grounds for divorce has been discussed. In the second chapter, information is provided about the divorce case due to adultery, which is one of the special grounds for divorce. Although the main focus of our study is the liability for compensation of third party, it is essential to make clarify the grounds for divorce and in which category the grounds for adultery is classified. The third section includes the conditions for the third party's liability for compensation in a divorce case due to adultery, the Supreme Court, doctrinal opinion and the opinion we support.
