Özet

Bu çalışma, uluslararası hukukta insani müdahale ve koruma sorumluluğu kavramlarını hem teorik hem de pratik düzeyde ele alarak, bu müdahale biçimlerinin insani krizlere ne ölçüde çözüm sunabildiğini analiz etmektedir. İnsani müdahale, bir devletin kendi halkına karşı ağır zulüm uyguladığı veya kitlesel kıyımlar gerçekleştirdiği durumlarda, dışarıdan gelen askeri müdahaleleri tanımlamak için kullanılan bir kavramdır. Ancak bu müdahaleler, devletlerin egemenlik ilkesine ve uluslararası hukukun temel kurallarından biri olan iç işlerine karışmama ilkesine aykırılık riski taşımaktadır. Bu nedenle insani müdahale kavramı, literatürde geniş tartışmalara yol açmıştır. Soğuk Savaş'ın sona ermesiyle birlikte artan bölgesel çatışmalar ve etnik temelli katliamlar, uluslararası toplumun bu tür krizlere daha duyarlı hale gelmesini sağlamıştır. Ancak insani müdahalelerin müdahale öncesi önleme, müdahale süreci ve müdahale sonrası yeniden yapılandırma gibi aşamaları yeterince kapsamaması ve uluslararası hukukun temel bazı ilkeleri ile oluşturduğu gerilim yeni bir anlayış ihtiyacını doğurmuştur. Bu bağlamda ortaya çıkan koruma sorumluluğu kavramı, sadece tepki verme sorumluluğunu (responsibility to react) değil, krizin doğmadan önlenmesini (önleme sorumluluğu- responsibility to prevent) ve sonrasında sürdürülebilir barışın ve etkin bir devlet mekanizması inşasını (yeniden inşa sorumluluğu- responsibility to rebuild) da içeren kapsamlı bir yaklaşım sunmakta ve klasik egemenlik anlayışına dair yeni bir bakış açısı getirmektedir. Tezde, bu teorik çerçeve, 2013'te Orta Afrika Cumhuriyeti (OAC) örneği üzerinden somutlaştırılmıştır. Uluslararası toplumun OAC'de yaşanan insani krizlere verdiği tepkiler ve özellikle Birleşmiş Milletler'in müdahale süreci değerlendirilmiştir. Yapılan analizlerde, müdahalenin sınırlı kapasiteyle gerçekleştirilmiş olması, uluslararası iradenin zayıflığı ve uzun vadeli çözüm mekanizmalarının eksikliği gibi nedenlerle müdahalenin yetersiz kaldığı ortaya konulmuştur. Bu bağlamda tez, koruma sorumluluğunun pratikteki uygulamasına dair eleştirel bir bakış sunmakta; literatürde sıklıkla yer bulan Libya ve Darfur gibi örneklerin yanında OAC müdahalesini özgün bir vaka olarak değerlendirmektedir. Sonuç olarak çalışma, öncelikle insani müdahale ve koruma sorumluluğu kavramlarını karşılaştırmalı olarak ele almakta, ardından koruma sorumluluğunun teorik idealleri ile sahadaki uygulama arasındaki farkı gözler önüne sererek“gelişmekte olan bir norm”olan bu kavramın hem etkinlik hem de samimiyet açısından sorgulanması gerektiğini ileri sürmektedir.

This study examines the concepts of humanitarian intervention and the responsibility to protect in international law at both theoretical and practical levels, and analyses the extent to which these forms of intervention can provide solutions to humanitarian crises. Humanitarian intervention is a concept used to describe external military interventions in cases where a state is committing atrocities or mass atrocities against its own people. However, these interventions carry the risk of contravening the principle of sovereignty of states and the principle of non-interference in internal affairs, which is one of the fundamental rules of international law. For this reason, the concept of humanitarian intervention has led to wide debates in the literature. With the end of the Cold War, regional conflicts and ethnic-based massacres have increased and the international community has become more sensitive to such crises. However, the fact that humanitarian interventions do not sufficiently cover stages such as pre-intervention prevention, intervention process and post-intervention reconstruction and the tension it creates with some basic principles of international law has led to the need for a new understanding. The concept of responsibility to protect, which emerged in this context, offers a comprehensive approach that includes not only the responsibility to react, but also the prevention of the crisis before it occurs (responsibility to prevent) and the construction of sustainable peace and an effective state mechanism afterwards. This study examines the concepts of humanitarian intervention and the responsibility to protect in international law at both theoretical and practical levels, and analyses the extent to which these forms of intervention can provide solutions to humanitarian crises. In the thesis, this theoretical framework is concretised through the example of the Central African Republic (CAR) in 2013. The responses of the international community to the humanitarian crises in CAR and especially the intervention process of the United Nations are analysed. The analyses revealed that the intervention was inadequate due to limited capacity, weak international will and lack of long-term solution mechanisms. In this context, the thesis provides a critical view of the practical application of the responsibility to protect and evaluates the CAR intervention as a unique case, alongside the Libya and Darfur examples that are frequently found in the literature. In conclusion, the study first comparatively analyses the concepts of humanitarian intervention and the responsibility to protect, and then demonstrates the difference between the theoretical ideals of the responsibility to protect and its practice in the field, arguing that this concept, which is an 'emerging norm', should be questioned in terms of both effectiveness and sincerity.
