Özet
Basın, kamuoyunu aydınlatma görevini üstlenen dördüncü bir kuvvettir. Basının temel ögesi ise gazetecidir. Gazeteci haberi toplar, analiz eder, değerlendirir, yorumlar ve kamuoyuna sunar. Haberin kamuoyuna sunabilmesi ise, basma ve dağıtma faaliyeti ile gerçekleşir. Bu faaliyetin korunması haber alma hakkını ve haber verme hakkının sürekliliğini sağlar. Bu bağlamda basın özgürlüğü, gazetecinin haber toplama aşamasını koruduğu gibi, aynı zamanda haberin yayılması aşamasını da korumalıdır. Ancak gazeteciler haber toplama aşamasında veya haberin sunulması aşamasında sansür gibi birçok tehditlerle karşılaşabilirler. Bu sebeple uluslararası ve ulusal metinlerde ifade ve/veya basın özgürlüğüne yönelik düzenlemelere yer verilmiştir. Fakat basın özgürlüğü mutlak bir hak değildir. Ancak sınırlandırma sebepleri niteliği gereği yoruma açık ve belirsizdir. Bu sebeple gazeteci fiziksel, psikolojik ve ekonomik tehditlerle karşı karşıya kalabileceği gibi hukuki tehditlerle de karşı karşıya kalmaktadır. Bu kapsamda gazetecinin korunabilmesi için özel bir koruma sağlanması elzemdir. Fakat basın özgürlüğü Anayasa hariç diğer hukuki metinlerin çoğunluğunda ifade özgürlüğü ile bağdaşık bir hak olarak düzenlenmiştir. Bu durum basın özgürlüğünün kapsamını daraltıcı bir etkiye sahiptir. Oysa basın özgürlüğü bünyesinde birçok hak ve özgürlüğü barındırır. Bu çalışmada öncelikle basın kavramı ile basın özgürlüğünün anlamı üzerinde durulacak; uluslararası ve ulusal düzeydeki normatif düzenlemeler çerçevesinde bu özgürlüğün hukukî temelleri incelenecektir. Ardından, basın özgürlüğüne yönelik güncel sorunlar tespit edilerek, yargı makamlarının bu sorunlara ilişkin tutum ve değerlendirmeleri açıklanacaktır.makamlarının bu sorunlara ilişkin tutum ve değerlendirmeleri açıklanacaktır.

The press is a fourth force that undertakes the task of informing the public. The basic element of the press is the journalist. The journalist collects, analyzes, evaluates, comments on the news and presents it to the public. The presentation of the news to the public is achieved through the activity of printing and distribution. The protection of this activity ensures the continuity of the right to receive news and the right to provide news. In this context, freedom of the press should protect the dissemination phase of the news as well as the news gathering phase of the journalist. However, journalists may encounter many threats such as censorship during the news gathering phase or the presentation phase of the news. Thus, regulations regarding freedom of expression and/or freedom of the press are included in international and national texts. However, freedom of the press is not an absolute right, and it could limit. Therefore, journalists may face physical, psychological and economic threats as well as legal threats. In this context, it is essential to provide special protection for the protection of the journalist. Freedom of the press is regulated as a right compatible with freedom of expression in many other legal texts except the Constitution. This situation has a narrowing effect on the scope of press freedom but it includes many rights and freedoms. In this study, first, the concept of the press and the meaning of freedom of the press will be emphasized; the legal foundations of this freedom will be examined within the framework of international and national normative regulations. Then, current problems regarding freedom of the press will be determined and the attitudes and evaluations of the judicial authorities regarding these problems will be explained.authorities regarding these problems will be explained.
