Özet
Bu tez, hukuk ile edebiyat arasındaki çok katmanlı ilişkiyi, Tanzimat'tan itibaren Osmanlı Devleti'nin hukuk anlayışının geçirdiği değişimleri ve özellikle Ahmet Midhat Efendi'nin fikrî ve edebî eserleri aracılığıyla hak, adalet duygusu, kanun, mahkemeler gibi unsurları nasıl ele aldığını ortaya koymayı amaçlamaktadır. Temel varsayım, edebiyatın yalnızca estetik bir üretim alanı değil, aynı zamanda toplumsal düzen, adalet, hak ve hukuk gibi kavramların sorgulandığı, yeniden tanımlandığı ve kamuoyuna aktarıldığı bir alan olduğudur. Bu bağlamda çalışma, hem hukuk disiplinine hem de edebiyat eleştirisine disiplinlerarası bir katkı sunmayı hedeflemektedir. Tezin giriş bölümünde edebiyat ve hukuk ilişkisine, iki alanın birbirini beslediği ve birbirinden ayrıştığı yönlerine değinilmiştir. Özellikle hukuki ve sosyal anlamda ilk değişikliklerin görüldüğü Tanzimat Dönemi ele alınmış, ardından edebiyat ve hukuk alanında Türk edebiyatındaki ilk yazı olan Hüseyin Cahit Yalçın'ın“Edebiyat ve Hukuk”makalesi esas alınarak temel bir inceleme yapılmıştır. Tezin ana eksenini oluşturan bölümlerde ise Ahmet Midhat Efendi'nin makaleleri, hikâyeleri ve romanları detaylı bir biçimde incelenmiş; bu eserlerde yer alan hukukî temsiller, adalet arayışları, mahkeme süreçleri, anlatıcının vicdanî yargısı ve ilahî adalet teması çok yönlü olarak analiz edilmiştir. Özellikle Esrâr-ı Cinâyât romanında gazetecilik, kamuoyu ve bireysel araştırmanın hukukî sürecin yerini aldığı; resmî adalet mekanizmasının işlemediği durumlarda yazarın anlatıcı kimliğiyle bir“edebî yargıç”işlevi üstlendiği gözlemlenmiştir. Adaletin yalnızca yazılı hukukla değil, ahlâk, vicdan ve toplumsal değerlerle birlikte işlerlik kazanabileceği vurgulanmıştır. Ahmet Midhat Efendi'nin eserlerinde yer alan hak duygusu, zayıfın yanında olma eğilimi, ferdî ahlâkın önemi ve toplumsal düzenin gerekliliği, bu tezin merkezinde yer alan kavramlardır. Yazar, romanlarında genellikle iyilerin ödüllendirildiği, kötülerin ise hem dünyevî hem de uhrevî düzlemde cezalandırıldığı bir yapı kurmakta; böylece ilahî adalet düşüncesini edebî bir adalet anlayışıyla harmanlamaktadır. Bu bağlamda, Ahmet Midhat Efendi'nin roman ve hikâyeleri hem dönemin hukuk sistemini ele alır hem de vicdana seslenen ahlâkî kılavuz mahiyetindedir.

This thesis aims to reveal the multilayered relationship between law and literature, the transformations in the Ottoman Empire's conception of law beginning with the Tanzimat period, and how Ahmet Midhat Efendi addresses concepts such as rights, the sense of justice, law, and the judicial system through his intellectual and literary works. The fundamental premise of the study is that literature is not merely an aesthetic field of production, but also a domain in which notions such as social order, justice, rights, and law are questioned, redefined, and conveyed to the public. In this respect, the study seeks to make an interdisciplinary contribution both to the field of law and to literary criticism. The introduction discusses the relationship between literature and law, focusing on the aspects through which the two fields both intersect and diverge. The Tanzimat Era, during which the first significant legal and social transformations emerged, is examined in particular. Subsequently, a foundational analysis is conducted based on Hüseyin Cahit Yalçın's article“Edebiyat ve Hukuk”(“Literature and Law”), considered the first text in Turkish literature to directly address the intersection of these two fields. In the main chapters that constitute the core of the thesis, Ahmet Midhat Efendi's essays, short stories, and novels are examined in detail; the legal representations, quests for justice, courtroom processes, the narrator's moral judgment, and the theme of divine justice in these works are analyzed from multiple perspectives. In particular, it is observed in the novel Esrâr-ı Cinâyât that journalism, public opinion, and individual investigation replace formal legal procedures, and that in instances where the official justice system fails to operate, the author assumes the role of a“literary judge”through his narrative voice. The study emphasizes that justice attains functionality not solely through written law, but also through morality, conscience, and social values. The notions of rights, the inclination to side with the weak, the significance of individual morality, and the necessity of social order—central concepts in this thesis—are recurrent themes in Ahmet Midhat Efendi's works. The author generally constructs narratives in which virtuous characters are rewarded, while wrongdoers are punished both in worldly and spiritual terms, thereby blending the idea of divine justice with a literary conception of justice. In this regard, Ahmet Midhat Efendi's novels and short stories both address the legal system of his era and function as moral guides appealing to the conscience.
