According to the Muslim jurists, the essential aim of the law is to provide what is best both for the individual and society. This fact, though accepted in general by all Muslim jurists, has some discrepancies in its formulations methodologically. Whereas some formulate it such terms as“maslahat-i mursala”,“istislah”and“istidlal”, others stated it as“istihsan”. Still some other jurists added these terms“sedd-i zerai”, (tmen-i tahayyül“ etc However, this discrepancy on the utility has been limited to the realm of theory, and in practice they have considered the utility when issuing a verdict Western philosophers have also put forward that the main line in law is the principle of utility, but they couldn't raise answer the question of which authority determine the utility. While Jhering, who supports the social utility, doesn't answer this question, Bentham, supporting the individual happines and hedonism. This matter has been discussed by Muslim jurists, and it has been established that the divine authority is what determines utility. They described the utility as what gains both the world and the world to come for human beings. To their opinion, utility is neither the hedonism nor the edomonism of the West Rather it is obtainment of some lasting values which are not contrary to the religious ones. The main problem arising with the application of the principle of utility to the practical life is the probability to conflict with the nass (verses). Although Muslim jurists oppose to this probability, it has been observed in many cases. To our opinion, the conflict here is not between the divine will and human utility, but rather between the literal interpretation of verses and hadiths and aspect of utility of any act If any conflict occures, as the principle ”aim and meaning is much more crucial than literal structure" puts it, and also as long as it exercises within the principles of Zaruriyyat, Haciyyat and Tahsiniyyat, there is no whatsoever any drawback in considering the utility, but rather in provide much contribution to solving the problems of contemporary world İ.C.
