The digital transformation driven by information technologies has exerted a profound influence on all spheres of social life, including criminal procedure and, in particular, the trial phase, which constitutes the most critical stage of criminal proceedings. Developments in information technologies—most notably in video conferencing systems, as a sub-branch of these technologies, as well as in the field of artificial intelligence—have converged with societal expectations for a criminal justice system that is more just, transparent, accessible, cost-efficient, and expeditious. This convergence has established the institutional foundation for the conduct of hearings in an electronic environment. The electronic hearing model enables the parties, other participants in the proceedings, and individuals who wish to observe the hearing pursuant to the principle of publicity to attend hearings remotely via video conferencing systems, irrespective of physical location and within an online setting. When the principles governing the conduct of hearings, together with the principles and rights encompassed within the right to a fair trial as enshrined in Article 6 of the European Convention on Human Rights (ECHR), are taken into account, it becomes evident that electronic hearings may be conducted without encroaching upon the essence of these rights and principles. Moreover, in certain respects, electronic hearings may afford greater protection and advantages to specific rights and principles when compared to traditional, in-person hearings. Beyond merely enabling hearings to be conducted online independent of physical location, the concept of electronic hearings denotes an ecosystem within which the innovations introduced by digital transformation may be systematically integrated.
