Özet
Yerel yönetimler günümüzde devlet teşkilatının temel unsurlarından biri olarak kabul edilmektedir. Bu idareler, kendilerine ait bütçeler aracılığıyla harcama, yatırım ve borçlanma yapabilme yetkisine sahiptir. Devletin taşradaki temsilcisi konumunda olan yerel yönetimler, halkın ihtiyaçlarını kendi topladıkları gelirler ve vergiler doğrultusunda karşılamaktadır. Ülkemizde birçok yerel yönetim biriminin, sunulan hizmetlerin eksiksiz ve nitelikli bir şekilde yerine getirilebilmesi amacıyla borçlanmaya başvurduğu görülmektedir. Sürekli yaşanan doğal afetler sonucunda devletin hizmet yükünün artması, yerel yönetimlerin borçlanma ihtiyacını daha da artırmaktadır. Bu borçlanma süreçlerine ilişkin uyulması gereken kurallar ise ilgili kurumlar tarafından belirlenmektedir. Yerel yönetim idareleri, yapıları gereği uymak zorunda oldukları çeşitli ilkelere sahiptir. Bu ilkelerin başında şeffaflık ve hesap verebilirlik gelmektedir. İdarenin attığı her adımın kamuoyuyla paylaşması, kuruma duyulan güveni önemli ölçüde güçlendirmektedir. Ancak ülkemizde bazı yerel yönetim birimlerinde tespit edilen yolsuzluklar nedeniyle zaman zaman belediye başkanlarının görevden alındığı ve yerlerine kayyum atandığı görülmektedir. Yasa dışı uygulamaların çoğalması ve kamu görevlilerinin kişisel çıkarları doğrultusunda hareket etmeleri, kamu idarelerine duyulan güveni zayıflatmıştır. Bu nedenle halkın güveninin yeniden sağlanabilmesi için idarelerin şeffaflık, hesap verebilirlik, açıklık, tutarlılık ve doğruluk gibi temel ilkelere uygun hareket etmesi beklenmektedir. Yerel yönetimler borçlanmaya başvurduklarında çeşitli kurallar ve zorluklarla karşılaşmaktadır. Bu zorlukların başında, borç temin edilecek kişi veya kuruluş ile sağlanacak mutabakat gelmektedir. Güven sorununu giderebilmek amacıyla kimi zaman garantör talep edilmekte; dış borçlanma yapacağı zaman genellikle Hazine ve Maliye Bakanlığı garantör olarak devreye girmektedir. Borçlanma sürecinde karşılaşılan bir diğer temel problem, borç miktarının veya vade süresinin yanlış belirlenmesidir. Türkiye'de henüz iflas eden bir yerel yönetim idaresi bulunmasa da dünya genelinde iflas eden yerel yönetim örnekleri mevcuttur. Bu çalışma kapsamında yerel yönetimlerin işleyişi, yapısı ve borçlanma süreçlerinde karşı karşıya kaldıkları sorunlara ilişkin ayrıntılı bilgilere yer verilmiştir.

Today, local governments are considered one of the basic elements of state organization. These administrations have the authority to spend, invest and borrow through their own budgets. Local governments, which are the representatives of the state in the provinces, meet the needs of the people in line with the revenues and taxes they collect. It is seen that many local government units in our country resort to borrowing in order to provide the services offered in a complete and qualified manner. The increase in the state's service burden as a result of constant natural disasters further increases the borrowing need of local governments. The rules to be followed regarding these borrowing processes are determined by the relevant institutions. Local government administrations have various principles that they must comply with due to their structure. The most important of these principles are transparency and accountability. Sharing every step taken by the administration with the public significantly strengthens the trust in the institution. However, due to corruption detected in some local government units in our country, it is observed that mayors are dismissed from time to time and trustees are appointed in their places. The proliferation of illegal practices and the fact that public officials act in line with their personal interests have weakened the trust in public administrations. Therefore, in order to restore public trust, administrations are expected to act in accordance with basic principles such as transparency, accountability, openness, consistency and accuracy. Local governments face various rules and challenges when they resort to borrowing. The most important of these difficulties is the agreement to be reached with the person or organization from which the loan will be provided. In order to eliminate the trust problem, a guarantor is sometimes requested; When it comes to foreign borrowing, the Ministry of Treasury and Finance usually steps in as a guarantor. Another basic problem encountered in the borrowing process is the incorrect determination of the debt amount or maturity period. Although there is no local government administration that has gone bankrupt in Turkey yet, there are examples of local governments going bankrupt around the world. Within the scope of this study, detailed information about the functioning and structure of local governments and the problems they face in their borrowing processes is included.
