Özet
Uzaktan Çalışmanın İş İlişkisi Üzerindeki Etkileri adlı bu tezde, uzaktan çalışmanın, işçi ve işveren arasındaki iş ilişkisi üzerinde oluşturmakta olduğu etkiler; öncelikle uzaktan çalışmanın ne olduğu, kavramsal olarak anlamı, tarihçesi ve hukuki düzenlemelerdeki yeri anlatılarak, uzaktan çalışmanın unsurları, tarafların borçları ve bu çalışma biçiminin avantaj ve dezavantajlarına değinilmiş olup son olarak da uzaktan çalışmanın iş ilişkisi uzerindeki etkilerinden, iş ilişkisinde meydana gelen dönüşümden, uzaktan çalışan işçilerin zamansal yönetiminden ve burada meydana gelen problemlerden, uzaktan çalışan işçilerin kişisel verilerinin korunması ve dijital izlenmeleri durumlarından, sosyal güvenlik hukuku ve toplu iş hukuku bakımından oluşan sonuçlardan ve uzaktan çalışmada iş ilişkisinin sonlanması halinden özellikle de değişiklik feshinden bahsedilmiştir. Bu kapsamda uzaktan çalışmada iş ilişkisinde meydana gelen durumların üzerinde durularak, uzaktan çalışmanın niteliği gereği sahip olduğu özelliklerinin, iş ilişkisi üzerinde meydana getirdiği neticeler incelenmiştir.

In this thesis entitled The Effects of Remote Work on the Employment Relationship, the impacts of remote work on the employment relationship between the employee and the employer are examined; first, by explaining what remote work is, its conceptual meaning, historical development, and its place within legal regulations, then by addressing the elements of remote work, the obligations of the parties, and the advantages and disadvantages of this form of work, and finally by discussing the effects of remote work on the employment relationship, the transformation occurring within the employment relationship, the temporal management of remote workers and the problems arising in this context, the protection of the personal data of remote workers and situations of digital monitoring, the consequences arising from the perspective of social security law and collective labor law, and the termination of the employment relationship in remote work, with particular emphasis on termination by way of change. Within this framework, by focusing on the situations that arise in the employment relationship under remote work, the outcomes created within the employment relationship by the characteristics inherent in the nature of remote work are examined.
