Özet
İslam'ın temel maksatlarından biri, nikâh akdinin teşrîi ve devamlılığının sağlanması yoluyla ailenin korunması ve insan neslinin devamının temin edilmesidir. Bu bağlamda, sözlü boşama ve buna şahit tutulması meselesi, ilgili ayetin boşamanın geçerliliği için şahitliği bir şart olarak mı öngördüğü, yoksa hakların korunması ve ihtilafların önlenmesine yönelik düzenleyici bir işlem mi olduğu konusunda fıkhî ve tefsirî bir tartışma alanı oluşturmaktadır. Bu durum, klasik ve çağdaş müfessirlerin ve fakihlerin görüşleri arasında karşılaştırmalı bir incelemeyi ve sosyal ile siyasal bağlamların bu görüşlerin şekillenmesindeki etkisinin ortaya konulmasını gerekli kılmaktadır. Bu araştırma, aile meselelerini ilahî murada uygun şekilde anlamayı amaçlayarak boşamada şahitlik konusunu farklı boyutlarıyla ele almaktadır. Bu çerçevede boşama kavramı ve onun klasik dilde kullanılan eş anlamlıları incelenmiş, ayrıca tarihsel bir mukayese ile Tevrat ve İncil'deki boşama anlayışı ve İslam öncesi Mekke toplumundaki uygulamalar değerlendirilmiştir. Çalışma ayrıca Kur'an'da boşama kavramı ve onunla ilişkili lafızlar için kavramsal bir ağ oluşturmayı ve semantik analiz yöntemiyle Kur'an'ın kelime yapısını ortaya koymayı hedeflemektedir. İlgili ayetler ile hadisler ve bunların bağlantılı olduğu olaylar birlikte ele alınarak Kur'an'ın bu meseleye ilişkin bütüncül yaklaşımı açıklanmıştır .Araştırmada istikrâî, istinbatî ve dilsel analiz yöntemleri kullanılarak kavramın Arap dilindeki anlamı ile Kur'an bağlamında kazandığı anlam arasındaki fark ortaya konulmuştur. Ayrıca boşamada şahitliğin bazı durumlarda teşrî edilmesinin makasıdî yönü incelenmiş; bunun aileyi koruma ve toplumsal zararı azaltmadaki rolü vurgulanmıştır. Çalışma, boşama türleri ve hükümlerine kısaca değinerek şahitlik meselesine zemin hazırlamış, klasik ve çağdaş müfessirlerin görüşlerini analiz ederek ihtilafın kaynaklarını ortaya koymuştur. Son olarak, Kur'an'ın aileyi koruma ve toplumu muhafaza etme yönündeki şer'î maksatları doğrultusunda mesele değerlendirilmiş, farklı mezheplerin görüşleri ışığında doğru anlayışın geliştirilmesi hedeflenmiştir.

One of the fundamental objectives of Islam is the preservation of the family and the continuity of the human species through the legislation and maintenance of the marriage contract. In this context, the issue of verbal divorce and the requirement of witnessing it has generated extensive juristic and interpretive debate regarding whether the relevant Qur'anic verse establishes witnessing as acondition for the validity of divorce or merely as aregulatory measure intended to preserve rights and prevent disputes. This necessitates acomparative study of the opinions of classical and contemporary exegetes and jurists, as well as an examination of the influence of social and political contexts on the formation of these interpretations .This study aims to address the issue of witnessing divorce, which has been the subject of multiple perspectives, and to answer key questions related to family matters in amanner consistent with the divine intent of the Qur'anic address. It therefore examines the concept of divorce, its synonymous expressions in earlier linguistic usage, and the associated legal rulings and maqāṣid-based values. The research adopts ahistorical comparative and inductive approach by examining the concept of divorce in the Torah and the Gospel, as well as its practice in pre-Islamic Meccan society. It also constructs aconceptual network of the term“divorce”and its related expressions within the framework of Qur'anic semantic analysis, showing how the Qur'an reflects meaning through associated and synonymous terms. To demonstrate the functional dimension of the Qur'anic text, connections are established between relevant verses, Prophetic traditions, and the events linked to them, thereby clarifying the comprehensive Qur'anic vision on the issue. The study also briefly addresses the types and rulings of divorce to provide afoundation for the main topic, namely witnessing divorce .Within this framework, the nature of witnessing in divorce is examined, along with the origin of scholarly disagreement and the type of divorce to which witnessing is analogically applied. The views of classical and contemporary exegetes are analyzed, particularly juristic-oriented interpretations .Amaqāṣid-based reading is also employed to highlight the objectives of preserving the family and reducing harm. Methodologically, the study relies on inductive, deductive, and linguistic analysis to distinguish between lexical and Qur'anic meanings and to clarify juristic developments within Islamic schools.
