Özet
Tesadüfen elde edilen delil kavramı, işlevi ve tesadüfen elde edilen delillerin hangi şartlarla ispat aracı olarak değerlendirilebileceği çalışmanın esasını oluşturmaktadır. Üç bölümden meydana gelen çalışmada sırasıyla, delil ve tesadüfen elde edilen delil kavramları ve delillerin ispat gücü, tesadüfen elde edilen delillerin görünümleri ile kullanılabilirlikleri üzerinde durulmuştur. Çalışmanın genelinde doktrindeki tartışmalar içtihatlarla desteklenmiş, sorunlara daha kapsamlı çözümler bulmak adına karşılaştırmalı hukuktan yararlanılmıştır.

The concept of evidence obtained incidentally, its function and the conditions under which the evidence obtained incidentally can be considered as proof is the basis of the study. In the study, which consists of three parts, the concepts of evidence and evidence obtained incidentally and the power of proof of evidence, appearance and usability of the evidence obtained incidentally are emphasized respectively. The discussions in the doctrine were supported by jurisprudence and comparative law was used to find more comprehensive solutions to the problems.
