Özet
Bu çalışma, Türk hukukunda ortak (birlikte) velayet kurumunu mevzuat, uluslararası sözleşmeler, yargı kararları ve doktrindeki tartışmalar çerçevesinde incelemektedir. Çalışmada öncelikle ortak velayetin Türk hukukundaki gelişim süreci ele alınmış; Avrupa İnsan Hakları Sözleşmesi'ne Ek 7 No.lu Protokol, Birleşmiş Milletler Çocuk Haklarına Dair Sözleşme ve ilgili diğer uluslararası düzenlemelerin ortak velayet tartışmasına etkisi değerlendirilmiştir. Ardından Türk Medeni Kanunu'nda velayete ilişkin hükümler incelenmiş ve boşanma sonrası ortak velayetin açık bir kanuni düzenlemeye sahip olmamasından kaynaklanan sorunlar ortaya konulmuştur. Çalışmada ayrıca ortak velayetin tanımı, unsurları, hukuki niteliği ve çeşitleri açıklanmış; boşanma sonrası ortak velayet ile evlilik dışı doğan çocuğun ortak velayeti ayrı başlıklar altında değerlendirilmiştir. Üçüncü bölümde ortak velayetin uygulanma şartları ve hukuki sonuçları; hâkimin rolü, çocuğun üstün yararı, anne-baba ve çocuk açısından sonuçlar, yerleşim yeri, kişisel ilişki, eğitim, sağlık, bakım kararları, nafaka ve giderlerin paylaşılması bakımından incelenmiştir. Son bölümde ise Türk hukukunda ortak velayete ilişkin temel sorunlar ve çözüm önerileri ele alınmıştır. Bu kapsamda mevzuatta açık düzenleme eksikliği, yargı kararlarında birlik sorunu, yüksek çatışmalı boşanmalar, aile içi şiddet ve istismar hâlleri, uzman raporları ve sosyal inceleme süreci değerlendirilmiştir. Çalışma sonucunda, ortak velayetin çocuğun üstün yararı temelinde açık, ayrıntılı ve uygulanabilir bir kanuni düzenlemeye kavuşturulması gerektiği sonucuna ulaşılmıştır.

This study examines the institution of joint custody in Turkish law within the framework of legislation, international conventions, judicial decisions, and doctrinal debates. It first analyzes the development of joint custody in Turkish law and evaluates the impact of Protocol No. 7 to the European Convention on Human Rights, the United Nations Convention on the Rights of the Child, and other relevant international instruments on the debate concerning joint custody. Subsequently, it examines the provisions of the Turkish Civil Code governing custody and identifies the problems arising from the absence of an explicit statutory regulation concerning joint custody following divorce. The study further explains the definition, elements, legal nature, and various forms of joint custody. It separately addresses post-divorce joint custody and joint custody concerning children born out of wedlock. The third chapter examines the conditions governing the application of joint custody and its legal consequences, with particular emphasis on the role of the judge, the best interests of the child, the legal consequences for parents and children, the child's residence, personal contact arrangements, education, healthcare, childcare decisions, maintenance, and the allocation of child-related expenses. The final chapter discusses the principal legal issues and proposes solutions concerning joint custody under Turkish law. In this context, it evaluates the absence of explicit statutory regulation, inconsistencies in judicial decisions, high-conflict divorces, cases involving domestic violence and abuse, expert reports, and the social investigation process. The study concludes that joint custody should be regulated under Turkish law through clear, comprehensive, and practicable statutory provisions based on the paramount principle of the best interests of the child.
