ABSTRACT SUBJECT: The Penalty of Fornication/Adultery in the Noble Qur'an and the Rajm (Stoning) SUPERVISOR: Assoc. Prof. Abdulaziz BAYINDIR PREPARED BY: Mehmet ÇELEN This thesis holds the illegal act of fornication/adultery and its penalty with, respect to the Noble Qur'an and the Prophetic traditions as well as the subject of“rajm”(stoning) under a seperate title. Fornication/adultery in the Qur'an is taken up under two headings; preventing the circumstances leading to fornication/adultery on one hand, causes and inner meanings of its prohibition on the other. However, the same subject in Psalms, Torah and Bible is held as comparison to Qur'an. After above-mentioned introduction part, the main focus of the thesis“the definition of fornication/adultery and its penalty”is examined. Under the title“the definition of fornication/adultery”, its terminological as well as vocabular meanings, their various usages and definitions in the Islamic sects are shown. Additionally, under“the penalty of fomication/adulteiy”, its terminological and vocabular meaning, as well as its worldly-religious penalties are taken into consideration. Meanwhile, the penalties applied to the act of fornication/adultery in the regulations of the Prophet Muhammad and his companions are presented in detail.“Imsak”,“eziyet”,“celde”and the penalty of limiting the freedom of marriage in Qur'an are clarified via Qur'anic verses. Leagal opinions of the Islamic sects, both sunni and shia schools, on the penalty of fornication/adultery are offered in detail. Determining the crime of fornication/adultery, witnesses, evidence and the factors causing the penalty of fornication/adultery to be anulled, are presented. Under the title of“rajm”(stoning), terminological-vocabular meanings of the word“rajm”as well as the opinions of Islamic sects are examined. Moreover, prophertic traditions and some other views are also mentioned with respect to the act of“rajm”. On the other hand, the claims about the existence of a Qur'anic verse on rajm are examined and concluded that these claims are far from being sound. Present approaches to the penalty of“rajm”is also persented. In conclusion, this thesis points out that, the penalty of“rajm”does not exist in Qur'an, despite the fact that it is transmitted as an act of prophetic sunneh having revelations of“ahad haber”.
