ÖZET Genç, İskender, İslam Hukuk Usulünde Mefhûm-ı muhalefet Kavramı ve Hukuki Değeri, Yüksek Lisans Tezi, Danışman, Doç. Dr. Şamil Dağcı, 96 s.“Hüküm itibariyle, zikredilmeyenin; zikredilene muhalif olması. ”şeklinde tanımlayabileceğimiz mefhûm-ı muhalefete Hanefîler, tahsîsu'ş-şey-i bi'z-zikr; Şafıîler ve Hanbeliler, mefhûm-ı muhalefet; Malikîler'de dehlu'l-hitâb isimlerini vermişlerdir. Şafiî'ye göre mefhûm-ı muhalefet, sıfat, zaman, mekan ve adet olmak üzere dört tanedir. Bu sayıyı on üçe kadar çıkartan usûlcüler de vardır. Aslında gerçek olan Kazvînî'nin dediği gibi,“Şartlarını taşıyarak takyid ve tahsis edilen mantûk türü miktarınca, mefhûm-ı muhalefet vardır. ”Hanefi usulenlerine göre, mefhûm-ı muhalefet sadece insanların konuşmalarında ve eserlerinde delilken, diğer mezheplere göre, hem insanların sözlerinde hem de nasslar'ın tamamında delildir. Mefhûm-ı muhalefeti delil olarak kabul eden usulenlerin çoğunluğuna göre, mefhûm-ı muhalefet, meşruiyetini ditin kendi yapısından alan, zannî bir delildir. Yine bunlara göre, aynı sıfata ve özelliğe sahip cinsler için, mefhûm-ı muhalefetin genel geçerliliği vardır. Hanefi usulcülerine göre, mefhûm-ı muhalefetle Sâri' in kastını tespit imkanı yoktur. Bunu delil kabul edenlere göre, İslam Hukukçusunun görevi, Şâri'in kastını bulabilmek için bütün gücüyle çalışmaktır. Mefhûm-ı muhalefet ise böyle bir çalışmadır. Bu çalışmayla da Şâri'in kastı bulunabilir. Mefhûm-ı muhalefetin delilliği konusunda usulcülerin üç ayrı görüşü vardır. İlk olarak, usulcülerin tamamına yakınına göre, mefhum-ı lakap delil değildir. İkinci olarak, insanların sözlerinde ve eserlerindeki mefhûm-ı muhalefet, bütün mezheplerce delildir. Son olarak ise, nasslardaki mefhûm-ı muhalefet, Mâliki, Şafiî, ve Hanbelîler'in büyük çoğunluğuna göre delildir. Hanefilere göre ise delil değildir. Usulcülerin bir çok konuda olduğu gibi mefhûm-ı muhalefette de farklı düşüncede olması, doğal olarak ibadetlere ve hukuka da farklılık olarak yansımıştır. Bu farklı yaklaşımların etkilerini, ibadetlerden, şahıslar, aile, ticaret ve ceza hukukundan verdiğimiz örneklerle inceledik.

ABSTRACT Genç, İskender“The Notion Mefhum-ı Muhalefet (Concept of Opposition) And Its Legal Value İn The Tradition Of İslamic Law”, Master Thesis, Advisor, Doç. Dr. Şamil DA?CI, 96 p. The Notion,“mefhum-ı muhalefet”which may be defined as“The ones which are not mentioned”is called“tahsisu'ş-şey-i bi'z- zike”by the Hanifis,“mefhum-ı muhalefet”by the Şafiis and Hanbeliis and“delilu 'l-hitab”by the Maliliis. According to Şafii, this concept can be classifned into four groups as“title, time, place and amount ”Actually, the truth is like the one defiend by Kazvini,“There are many mefhum-ı muhalefet the same number the logical attributions which exceed its meening and gain a ”limited“ or ”attributed" meening. According to Hanefi methodists, this concept can be regarded as evidend not only in people's speeches and masterpiecis but also in people's words and deeds, according to the other sects. According to the most most methodists who accepted mefhum-ı muhalefet as evidence, mefhum-ı muhalefet is a hypothetical evidence, the legality of which stems from autentic structure of the language itself. That's, according to them, for the classifications hawing the same quality and properity, mefhum-ı muhalefet has a universal validity. According to the Hanefi methodists, it is not possible to determine Şari's intention via mefhum-ı muhalefet According to those regarding this as evidence, the duty of an İslamic Jurist is to study as much as possible to define Şari's intention mefhum-ı muhalefet is such a study. Through such a study, Sari's intention could be ascertained. About the evidence of mefhum-ı muhalefet, the methodists have three different ideas. First, according to nearly all the methodists, mefhum-ı lakap is not evident Second, mefhum-ı muhalefet in people's utterances and works is evident in all sects. Finally, mefhum-ı muhalefet in clear cut statements is evident accerding to many Malikis, Şafîis and Hanbelis. However, it is not evident according to Hanefis. Since the methodists have different opinions about mefhum-ı muhalefet just like in several issues, this was naturally reflected differently in rituals and law. The impacts of these different approaches were examined in this study with examples from worship rituals, persons, family life, commerce and punitive law.
