Özet
öz Bu çalışmada temel soran, günümüzde çıkar ve güç ilişkileri içinde devletler tarafindan içeriksizleştirilen, insanın“değer”ve“onur”undan uzaklaştırılan“hak”kavramının incelenmesidir. Bu nedenle hak kavramının, insan için vazgeçilemez bir değer olduğunu gösterebilmek için, Kant'ın evrensel olduğunu iddia ettiği ahlak anlayışı temel alınmıştır. Çalışmamızda hak kavramının incelenmesi, insan haklarının tarihsel gelişimi şeklinde değil, Kant'ın düşünce sistemi içinde ele alınmıştır. Neden Kant ve hak kavramı? Sorusuna da yanıt olmak üzere önce, İnsan aklı her şeyi bilebilir mi? Sorusundan hareketle Kant'ın bilgi sistemini, daha sonra nasıl yaşamalıyım? Sorusundan hareketle ahlak sistemini ve insan nedir? Sorusundan hareketle hak kavramını inceledik. Sonuç olarak;“hak”kavramı özgürlük kavramına dayanan ve ödev duygusuyla paralellik gösteren hukuki bir kavramdır;“hak”ların korunması ve geliştirilmesi evrensel nitelikte olan ve ahlaka dayanan bir siyasetle mümkündür“ yargılarına ulaştık. ABSTRACT The main object of this study is to investigate the concept of ”right“ which is deprived of its content in the relations of might and self-interest by the states and removed away from the ”values“ and the ”honour“ of the human being; hence to be able to show that the concept of ”right“ can not be forsaken, this study is based on Kant's ethics, which he claims to be universal. In our study the concept of ”right“ is not investigated throughout its historical development, but studied according to its place in Kant's philosophy. First, in an attempt to clarify Why Kant and why concept of ”right“, we started with the question of Can human reason know everything? and studied the epistemofogy of Kant, then comes our investigation of his ethics on the bases of How should I live? Finally, the question of What is human being? became our start point to study the concept of ”right“. In the end, we concluded that the concept of ”right“ is a legitimate concept that depends on the concept of freedom and has similarities with the duty sense and ”protecting and flourishing 'right'" is only possible under a universal ethics-based politics.
