SUMMARY In 1930 the General Hygiene Act has come into force in Turkey, and in 1952 the Food Regulation are put in practice. 26 acts, 3 regulations, 10 instructions and more than 100 standards and ministry circulars related to food caused problems for the producer, consumer, law and forensic sciences and lead also to legal blanks. In 1995 a new food law has been started to establish with the Governmental Decision number 560 about Production, Consumation and Audit of Foods. Within the scope of the efforts to reestablish the food law, Turkish Food Codex Instruction has come into force in 1997. Turkish Food Codex Instruction includes entire compulsory procedures in each stage beginning from the production to the presentation of the food to the consumer. These are: Pecularities of food related to quality and hygiene Food additive materials Aroma materials Pestisite and veterinary medicine remnants Food adhesives Packaging and labeling procedures Food storage and transportation rules Food sample and analysis methods Special announcements related to the Turkish Food Codex Instruction are going on to be published and completed. Besides the Governmental Decision number 560, Instruction for Food Production and Sale Locations and Instruction for Production, Consumation and Audit of Food has also come into force, but the Food Regulation is also in force yet. Ministry of Agriculture and Village Affairs, Ministry of Health, Ministry of Industry and Commerce, Ministry of Finance and Customs, Ministry of Internal Affairs, Ministry of Justice, Tresury and External Commerce Councelorship and the Institute of Turkish Standards are involved in the audit and control of food safety. Food control needs an integrated approach. The observation is an obligatory piece in the chain of maintanance of food safety. Observations are also guiding the preparers of legal arrangements. According to the WTO / SPS agreement, food safety assessments are carried out by the Codex Alimentarius Commission and the contact point in our country is the Ministry of Agriculture and Village Affairs. Risk analysis studies in food safety are inspected by WHO and FAO and the results are reported to countries on request. One of the most integrated approaches in food safety is the Hazard Analysis Critical Control Points (HACCP). This food control system has to be applied by food producers and traders. The official control of food quality is made in laboratories of the Ministry of Agriculture and Village Affairs, Ministry of Health and in the laboratories of the Chemical Analysis Specialisation Department, State Institute of Forensic Medicine, Ministry of Justice. In the case of negative reports, an allegation will be brought against those who are concerned with. The State National Institute of Forensic Medicine is an official expert. The 5. Specialization Board of the State Institute of Forensic Medicine, Ministry of Justice, investigates legal investigation files, related reports, and police or court report certificates related to foods and other items mentioned in the Food Regulation and gives reports concordant with the related law, regulations, instructions, standards and announcements. In this study files referred through the courts and prosecutorships to the 5. Specialization Board of the State Institute of Forensic Medicine after the publication of the new Turkish Food Codex Instruction will be investigated in order to evaluate seperately: The sufficiency and reliability of quality control studies carried out in the laboratories, Whether the loboratory findings about quality and safety of food and other ingredients are sufficient, Whether the control of food additives is sufficient, 135Malpractice caused by laboratory and supervision staff, Whether the questions of courts and prosecutorships are adequate In addition, in the case of discrepancies with the Food Regulation sanctions mentioned in the Turkish Criminal Law and in the case of discrepancies with the new codex sanctions added to the Governmental Decision number 560 about Production, Consumation and Audit of Foods with act number 4128 will be compared. The quality and safety of foods is determined by physical, chemical and microbiological studies. The courts and prosecutorships refer their questions about foods and other ingredients according to both, the Food Regulation and standards, and regulations, decisions and announcements published after 1995 Legislation Food is one of the most important components of a healthy life. Therefore it is the duty of the State to control the quality and the safety of food on the way from the land to the consumer. Actual law, regulations, instructions, compulsory and voluntary standards, new announcements related with food in our country will be investigated from the aspect of the practitioner, producer, consumer, law and forensic sciences. 136
