Özet
Bu tezin amacı, adalet sisteminin güvenilirliğini sağlayacak olan Delil Güvenliği konusunu incelemek, Türkiye'de yürürlükte olan mevzuat ve mevcut uygulamalar ışığında hâlihazırdaki Delil Güvenliği Sürecini değerlendirerek, sözkonusu süreçte Toplam Kalite Yönetiminin önemini vurgulamaktır. Üç bölümden oluşan tezin; birinci bölümde delil ve delil güvenliği ile ilgili kavramlar, ikinci bölümde sınıflarına göre delillerin güvenlikleri, üçüncü bölümde de delil güvenliği sürecinde kalite yaklaşımı, incelenmiş ve değerlendirilmiştir.Tezin konusunu oluşturan delil güvenliği; bir toplumun vicdanı konumundaki adalet sisteminin işlemesinde en temel gereksinim olan delilin, bozulmadan yani hukuka uygun bir şekilde kalması ve doğruyu yansıtması için devletin yerine getirmesi gereken zorunlu bir görevdir. Anılan görevin tam bir şekilde yerine getirilmesi, diğer bir ifadeyle güvenliğin eksiksiz sağlanması, adalete olan güveni tesis edecektir.Hukuk devletinde güvenilirliği tesis eden delil güvenliğinin, Toplam Kalite Yönetimi anlayışıyla yürütülmesi; işleyiş süreci, koordinasyon, hesap verebilirlilik ve denetim mekanizmaları açısından, bilim ve teknolojinin adalet sistemi içerisinde daha doğru bir şekilde yer almasını sağlayacaktır.

The aim of this thesis is to analyze the issue of Evidence Safety which will ensure the reliability of the justice system, to evaluate the Evidence Safety Process in the light of existing practices and legislation that is in force in Turkey and to emphasize the importance of Total Quality Management in this process. This thesis consists of three chapters. In the first chapter meanings some concepts of the evidence and safety, in the second chapter evidence safety, in the third chapter quality approach at Evidence Safety Process, have been examined and evaluated.Ensuring the safety of evidence, the subject of this thesis, is the mandatory duty of the states so that the evidence, which is the basic requirement for the functioning of the justice system, remains unchanged or -in other words- lawful and leads to the truth. Trust in justice will be achieved once this duty is performed properly and completely and an absolute safety is guaranteed.Evidence safety establishes reliability in the states governed by the rule of law. From the operational process, coordination, accountability and supervision mechanisms aspects, when such safety is realized together with the Total Quality Management approach; this will place science and technology in the justice system and will bring a modern insight into the evidence safety process.
