Özet
Bu çalışmanın amacı, hak kavramının yapısı ve fonksiyonu bakımından analiz edilmesi suretiyle, ?Hak nedir?? veya ?Bir hakka sahip olmak ne demektir?? sorusuna bir yanıt aramaktır. İlk bölümde, hak kavramı yapısal bakımdan analiz edilmeye çalışılmıştır. Kavramın yapısal analizinde Amerikalı hukuk teorisyeni Wesley N. Hohfeld'in yaklaşımı temel alınmıştır. Bu analiz çerçevesinde, hak kavramını meydana getiren kurucu bileşenlerin belirlenmesi sorunu üzerine odaklanılmıştır. İkinci bölümde ise hak kavramını açıklamaya yönelik olarak geliştirilmiş olan iki ana teorinin klasik versiyonları ele alınmıştır. Kıta Avrupası kökenli olan klasik irade ve çıkar teorileri, en önemli temsilcilerinin görüşleri üzerinden incelenmeye çalışılmıştır. Ayrıca çalışmanın bu bölümünde çağdaş Anglo-Sakson irade ve çıkar teorilerinin çıkış noktası olan Jeremy Bentham'ın hukuki hak kavramı analizi üzerinde durulmuştur. Üçüncü bölümde ise, çağdaş Anglo-Sakson irade ve çıkar teorisi yaklaşımları en önemli ve etkili temsilcilerinin görüşleri bağlamında incelenmeye çalışılmıştır. Hak kavramının teorik olarak analizine ilişkin bu iki rakip teori arasındaki tartışma günümüzde halen daha tüm hızıyla devam etmektedir. Çalışmanın bu kısmında çağdaş tartışmalar bağlamında söz konusu teorilerin hak kavramına getirdiği açıklama biçiminin ve bunun ortaya çıkardığı sorunların bir değerlendirilmesi yapılmıştır.

The title of this thesis is ?The Analysing the Concept of Rights According to the Philosophy of Law?. Concept of rights is the most fundamental and significant concept of law. The aim of this study is to analyse this concept into its components and to analyse it according to its function. I assumed that, by adopting this kind of approach, it could be possible to find an answer for this question, which has a great ambiguity: ?What a right is?? or ?What is it to have a right??. In the first chapter, I tried to analyse this concept into its basic components. This goal is founded on Wesley N. Hohfeld?s, who is an American legal theorist, analysis of the notion of legal rights. In the second chapter, I focused on the classical versions of the will theory and the interest theory. These two theories was formulated for the aiming of explaining the notion of rights. Classical versions of these theories are examined by considering their most important representatives? point of viewes. In this chapter Jeremy Bentham?s theory of legal rights is also examined. His theory is accepted by many authors as the starting point of the contemporary Anglo-Saxon versions of the will theory and the interest theory. Third chapter deals with contemporary Anglo-Saxon versions of the will theory and the interest theory. These two theories could be seen as two rival but prominent theoretical analyses of the concept of rights. In other words contemporaray debate on the nature of rights has been continiuing between these theories. In this chapter I was also focused on issues raised by these theories.
