Özet
Tezde araştırılan konu, Türk Pozitif Hukuku'nda genel kanuni düzenlemesi olmayan, ancak pek çok adaletsizliğe çözüm olabilecek ?Güven Sorumluluğu? kavramıdır. Tezimizin Birinci Bölümü'nde, ?Güven? kavramı ve ?Güven İlkesi? incelenmiş, ikinci bölümde, Alman Hukuku'nda, kavramın nasıl doğduğu, ne anlama geldiği ve 2002 yılındaki, Alman Borçlar Hukuku Reformu'yla ne tür bir kanuni düzenlemeye kavuşturulduğu ele alınmıştır. Üçüncü bölümde, Güven Sorumluluğu'nun, Alman Hukuku'nun da etkisiyle, İsviçre Federal Mahkemesi kararlarına konu olması ve İsviçre Hukuk Uygulamasında ifade ettiği anlam araştırılmıştır. Dördüncü bölümde de, ?Güven Sorumluluğunun?, Türk Borçlar Hukuku'nda yer alıp almadığı, nasıl anlaşılması gerektiği ve benzer hukuki kurumlardan farklılığı ?net? olarak ortaya konmaya çalışılmıştır. Bu araştırmada, kullanılan yöntem, Mukayeseli Hukuk Yöntemi'dir. Sonuç olarak, kavramın Türk Borçlar Hukuku için başka hukuki kurumların uygulama alanına girmeyen, adaletsiziklere çözüm olan bir sorumluluk kaynağı olduğu kanaatindeyiz.

This study has been prepared as a doctorate thesis at Istabul University Social Sciences Institute. The topic that was researched in the thesis is the concept of trust responsibility (Liability based on Reliance) which is not common legitimate regulation in ?Turkish Positive Law? but might be a remedy for so many inequities. In the first section of our thesis, in order to understand the reason of emergence of Trust Responsibility concept, we analyzed the concept of ?Trust? and ?Trust Principle?. Afterwards, in the second section, we analyzed how this concept emerged In German Law in which it was discovered, what its mean is and with the German Law of Obligations Reform in 2002 we analyzed what kind of legitimate arrangement it was applied. In the third section, we researched the matter of Trust Responsibility into Switzerland Federal Court?s decisions with the effect of German Law as well and its mean stating on Switzerland Law Application. In the fourth section, we have clearly tried to bring up whether Trust Responsibility states on Turkish Law of Obligations or not, how to understand, and its difference from the same law institutions. The method that was used in this research is Comparative Law Method. Consequently, we believe that the concept does not enter into the other legal institutions application area for Turkish Law of Obligations, is a responsibility source that is the remedy for inequities.
