Özet
Devletin ekonomi içindeki ağırlığının,kamu hizmeti anlayışının ve sunum biçimlerinin değişmesiyle kamu kurumları mal,hizmet ve yapım işlerinin teminine yönelik ekonomik faaliyetlerini artan oranda özel sektöre devretmektedir.Bu durum da idarenin mal ve hizmet edinme usullerinden biri olan kamu ihalelerinin kullanımını ve önemini arttırmaktadır.Kamu ihaleleri alanının öneminin artması sonucunda kaynakların kullanımında etkinliğin ve verimliliğin sağlanması amacıyla,hem dünyada hem de Türkiye'de kamu ihalelerinde önemli reform çalışmaları gerçekleştirilmiştir.Bu reform çalışmaları ile; rekabetçi,saydam,hesap verebilir,güvenilir ve kamuoyu denetiminin yer aldığı bir kamu ihale sistemi oluşturulması hedeflenmiştir.Bu bağlamda çalışmanın özünü;Türkiye'de reform çalışmalarıyla oluşturulan yeni kamu ihale sisteminin,4734 sayılı Kamu İhale Kanunu ve 2886 sayılı Devlet İhale Kanunu çerçevesinde incelenmesi ve uluslararası belgelerdeki kamu ihale sistemine uyumunun değerlendirilmesi oluşturmaktadır.

With the changes of the state's weight in the economy,and with the shift of the understanding and the types of presenting the publis services,the public institutions have handing over the economic activities related with the getting of goods,services and the construction affairs to the private sector in an increasing degree.This paves the way for a more important perception of the public procurement that was one of the ways through which the government aims to gain goods and services.as a result of the increasing significance of the procurement,and with a goal of creating efficiency and efficacy in using there sources,both in Turkey and in other countries important reforms movements have begun.By the help of these reforms,a competitive,transparent,accountable and open to public audit public procurement system has been targeted.In this contextual framework,the essence of the study consists of both the examination of the new public procurement system which was made by the reform movements within the framework of Public Procurement Law of Number 4734 and with the Law of State Tender of Number 2886.Apart from that, the evaluation of The TurkishCase'sharmony with the other countries is another dimension of this study.
