Özet
Evlilik ve evlilikte kadının yeri, her hukuk sisteminin en önemli konularındandır. Eski hukuk sistemlerinde, evlilikle ilgili hükümler ve evlilikte kadının konumu,birbirine büyük benzerlik göstermektedir. Bu hukuk sistemleri ve onların dayandığı felsefe, günümüzde halen etkilerini korumaktadır. Kadının evlenme yetkisini sınırlandıran ve onun, hem ailede, hem toplumdaki yerini pasifleştiren eski hukukun aksine, Kur'an'da ve Hz. Muhammed'in uygulamasında evlilik her iki tarafın hür iradesine dayalı bir işlemdir ve evlilikte her iki tarafa adil bir şekilde hak ve sorumluluklar yüklenmiştir.

The marriage institution together with the position of the woman within this institution are among the most important issues of every juridical system. The similarities among the commands and laws of diverse ancient legal systems regarding the marriage institution and the position of the woman within this sytem are obivous and many in number. In addition, these systems and the philosophical background they have been based on are still effective nowadays. In contrast to these juridical systems that enforce boundaries to the woman?s competences and in marital decisions and also place her in an inferior and pasive position in society, the marriage institution revealed in the Holy Koran and applied by the Prophet Mohamed (peace be upon him) is a conctract undertaken by both sides regarding their freewill that also charges both of them with impartial rights and responsibilities.
