Özet

John Rawls'un Bir Adalet Teorisi isimli eseri 1971'de yayınlandı ve birçok kişi tarafından modern siyaset felsefesindeki en önemli kitap olarak kabul edildi. Rawls'un teorisindeki en yenilikçi fikir farklılık prensibidir. Refah devleti prensibi olarak anlaşılan bu prensip, gelir ve refahın zenginden fakire doğru yeniden dağılımını gerektirir. Bununla birlikte, Türkiye gittikçe bir refah devletine dönüşme yolundadır. Bu yüzden, refah devleti için belirlenmiş güncel felsefî nedenleri anlamak oldukça ilginç olacaktır.Bu nedenler gerçekten ikna edici midir? Refah devletine ilişkin en önemli eleştiriler nelerdir? Bu soruları tartışmak üzere, tezin bir bölümünde Robert Nozick'in 1974'te yayınlanan önemli kitabı Anarşi, Devlet ve Ütopya'da açımladığı Rawls'un farklılık prensibinin özgürlükçüeleştirisideğerlendirilecek.Rawls'a göre yetenek ve kabiliyetler toplumun ortak faydası için kullanılan ortak değerlerdir ve özellikle de toplumun en az avantajlı kesimi için kullanılmalıdır. Nozick, bu ahlaki yargıya kesin bir şekilde karşı çıkar ve insanların sahip oldukları yetenek ve kabiliyetleriyle kendi gelirlerini elde etmeyi hak ettiklerini savunur. Nozick'e gore, `kazandıklarının vergisi bir anlamda zorunlu işçiliktir'. Bu tez, Rawls ve Nozick'in argümanlarının birleştirilerek refah devletinin nedenleri ve sonuçları hakkında daha iyi bir anlama ve değerlendirmeyi amaçlamaktadır.

John Rawls?s A Theory of Justice, published in 1971, and is widely recognized as the most important book in contemporary political philosophy. The most innovative idea of Rawls?s theory is the difference principle. This principle is to be understood as the principle of the welfare state as it calls for the redistribution of income and wealth from the rich towards the poor. Also Turkey is transforming more and more into a welfare state. So it is very interesting to understand the current philosophical reasons given for the welfare state.Are these reasons really convincing? What are the most important critiques of the reasons for the welfare state? In order to debate these questions a section of the thesis will examine the libertarian critique of Rawls?s difference principle phrased by Robert Nozick in his book Anarchy, State and Utopia published in 1974.According to Rawls, talents and capabilities are common assets to be used for the common advantage of society and especially for the least advantaged members of the society. Nozick strongly disagrees with this moral judgment and argues that people own their talents and capabilities and deserve the full income they can do with them. According to Nozick, ?Taxation of earnings is on a par with forced labor?. Through a confrontation of Rawls?s and Nozick?s arguments the thesis aims at a better understanding and evaluation of the pros and cons of the welfare state.
