Özet
“Çocuğa Yönelik Cinsel Şiddet Olaylarında Olay Kurgusunda ve Şüpheli İfadelerindeki Ortak Özelliklerin İncelenmesi”isimli tez çalışmasında, kolluk süreci içerisinde mağdurların bildirimi ve şüpheli ifadelerinin analizine bağlı olarak olay kurgusunun anlaşılması ve aktarımlardaki ortak özelliklerin tespit edilebilmesi için bir takım parametreler ışığında hareket edilmiştir. Böylelikle cinsel istismar vakalarının betimlenmesi ve açıklanması amaçlanmıştır. Çalışmanın ilk bölümü, cinsel istismar ve cinsel istismarın ahlaki-sosyal ve hukuki boyutu, mağdur-şüpheli ilişkisi, cinsel istismarın mağdurda etkileri vs. ve soruşturma-kolluk süreci ile cinsel istismarla ilgili teorilerin irdelendiği literatür taramasından oluşmuştur. İkinci ve üçüncü bölümde, çalışmanın hazırlanmasındaki prosedür anlatılmış ve yapılan analizin çıktıları ortaya konmuştur. İkinci bölümde çalışmadaki gerekli izin ve onaylar ile verilerin nasıl toplandığı, örneklemin nasıl oluşturulduğu ve hangi araştırma yöntemine başvurulduğu belirtilmiştir. Üçüncü bölümde ise elde edilen veriler ve hipotezler çeşitli istatistiki yöntemlerle analiz edilmiştir. Yapılan analiz ve değerlendirmeler betimleyici ve ilişkisel olmak üzere iki bölümde yer almıştır. Bu çalışmada araştırmanın bulguları; mağdurun yaşı, cinsiyeti, istismar şekilleri, mağdur-şüpheli ilişkisi, mağdurun istismarın sonrasında hissettiği psikolojik tepki ve yakınmalar, istismarın sürekliliği, istismarın anlatılamaması, müştekinin olayı öğrenmesi ile verdiği tepkiler ve mağdura yaklaşımı ile şüphelinin kendini savunma şekli ve bilişsel çarpıtma yöntemleri çerçevesinde yapılan benzer çalışmalar (ulusal ve uluslararası) ve konu ile ilgili literatürle tartışılmıştır. Mağdur ve şüpheli bildirimlerinin hangi ortak özellikler altında toplandığının cevabı aranmıştır. Bunların genel olarak mağdurun bulunduğu gelişimsel çağa (0-12 ve 13-15), penetrasyonun olup olmamasına, şüphelinin hane içinden olup olmamasına göre vs. olduğu görülmüştür. Çalışmanın son kısmında ise cinsel istismar vakaları betimlenerek; literatürün zenginleştirilmesi, cinsel istismar soruşturmalarının etkinleştirilmesi, hukuki düzenlemeler, bilgilendirici-bilinçlendirici faaliyetler ve eğitim faaliyetlerinin arttırılması vs. gibi konularda önerilerde bulunulmuştur.

In the dissertation named:“The Examination of Common Features of Suspects' Expressions and the Construction of Sexual Violence Cases against Children”, we worked in the light of certain parameters in order to understand the construction of the case and determine the common features of suspects' expressions in the law enforcement process. Thus, we aimed to describe and explain the cases of children's sexual abuse. The first part of the study includes a literature review on child abuse, child sexual abuse, moral-social and legal aspects of this issue, victim-suspect relations, the effects of sexual abuse on children, as well as the process of law enforcement during the sexual abuse inquisition and the theories of sexual deviance and sexual abuse issues. In the second and third parts, we explained the procedure and presented the outcomes of the analyses. In the second part, we described how the data was collected by taking the necessary permits and approvals, how the sample was selected and the related research method was administered. In the third part, we analyzed the data in the light of our hypotheses with various statistical methods. The relevant analyses and assessments were reported in two sections: descriptive and relational analyses. The findings of this research were compared with some similar studies (national and international) and the literature related to child sexual abuse in terms of the following dimensions; victims' age and gender, forms of abuse, victim-suspect relations, post-traumatic responses and complaints of victims, victims' parents approaches and responses, defense mechanisms and cognitive distortions of suspects. Thus, we analyzed the commonalities of suspects' and victims' expressions. We found that these commonalities depend on certain factors such as the victim's age (0-12, 13-15), whether there was a penetration or not and whether the suspects was a family member of the victim or not. In the final part of the research, sexual abuse cases were described and some further suggestions were made on the issues such as enriching the literature of sexual abuse, making the investigations of sexual abuse more effective, legal regulations, and increasing the number of informative and awareness-raising activities.
