Özet

Bu çalışmamzda Ebu'l-Berakât en-Nesefî'nin (ö. 310/710)“Medâriku't-Tenzîl ve Hakâiku't-Te'vîl”adlı eserindeki ahkâm ayetlerine yaklaşım tarzını açıklamaya çalıştık. İslamî ilimlerin her sahasında eserler vermiş olan en-Nesefî'nin tefsir alanında yazmış olduğu tek eser“Medâriku't-Tenzîl ve Hakâiku't-Te'vîl'dir. Bu eser, sade, kısa, kolay anlaşılır olmasının yanında içerik bakımından son derece zengin bir eserdir. Araştırmamız, bir giriş ve on bir bölümden oluşmaktadır. Çalışmamızın birinci bölümünde araştırmanın amacı ve metodu hakkında genel bilgi verdik. İkinci bölümde hayatı, ders aldığı hocaları, yazmış olduğu eserleri, yetiştirmiş olduğu önemli talebeleri ve ”Medâriku't-Tenzîl ve Hakâiku't-Te'vîl" hakkında genel bilgi verdik. Üçüncü bölümde en-Nesefî'nin temizlik ile ilgili ahkâm ayetlerine karşı tutumunu belirledik. Teyemmüm ve gusül konuları hakkındaki yorumlarını tespit ettik. Dördüncü bölümde ibadet konuları olan ezan, namaz, oruç, hac, zekât ve kurban ile ilgili yorumlarına yer verdik. Beşinci bölümde aile hukuku konuları olan evlilik, nikâh, talâk gibi konular hakkındaki ayetlerle ilgili yorumlarını aktardık. Bu konularla alakalı olan genel şartları açıklamaya çalıştık. Altıncı bölümde ise miras hukuku konuları hakkındaki ahkâm ayetleri genel olarak açıklanmaya çalışılmıştır. Konu ile kavramları genel olarak verdik. Bu bölümde en-Nesefî'nin konu ile ilgili ayet yorumları genel olarak açıklanmıştır. Yedinci bölümde borçlar hukuku ile ilgili konular ele alınmış ve müfessirin konu ile ilgili ayetlerle ilgili yorumlarına yer verilmiştir. Sekizinci bölümde ceza hukuku hakkındaki yorumlarına yer verilmiştir. Bu kısımda ceza konusunda genel ilkeler yanında özel cezalar hakkındaki içki, zina, kazf, sirkat, bağy gibi ayet yorumları, kısas cezaları ve ta'zir cezaları ile ilgili ayetler hakkındaki yorumlarına yer verilmiştir. Dokuzuncu bölümle muhakeme hukuku konuları olan şahitlik ve şahitlerde aranan genel ve özel şartlarla, şahitlerin yemin ettirilmesi ve şahitlikten dönme konuları ile ilgili ayet yorumlarını aktardık. Onuncu bölümde devletler hukukunu üç kısım halinde işledik. Birinci kısımda Müslüman yöneticilerde bulunması gereken özellikleri, ikinci kısımda temel haklar konusunu, üçüncü kısımda ise savaş hukuku konuları hakkındaki ayetleri tespit ederek en-Nesefî'nin yorumlarını aktardık. On birinci bölümde yukarıda açıklamaya çalıştığımız konular dışında kalan değişik konular hakkındaki müfessirin yorumlarını verdik.

In this our study Berakât Abul-en-Nasafi's (d. 310/710)“Medâriku't-Less and Hakâiku't-tawil”canon verse in his work tried to explain the approaches. Islamic works in every field of science, which gave the most-Nasafi only work which was written in the commentary of the“Medâriku't-Less and has Hakâiku't-Te'vîl'. This work, simple, short, easy to understand besides being extremely rich in terms of content is a work. Our research consists of an introduction and eleven departments. In the first part of our study of the research have given general information about the purpose and method. In the second part of life, of course, his mentor, his works have been written, taught his followers to be important and ”Medâriku't-Less and Hakâiku't-tawil" We gave general information about. In the third chapter, verse judgments about the cleanliness of the most-Nasafi have determined the attitude against. Teyemmüm reviews and ablution issues we've identified. In the fourth chapter, which issues the call to prayer worship, prayer, fasting, pilgrimage, alms and gave place to comment on the victim. In the fifth section with family law issues, marriage, nuptials, plunder their comments about the verses about topics such as have transferred. General terms and conditions that are relevant to these issues have tried to explain. In the sixth chapter judgments on issues of inheritance law verses have been explained in general. We gave the concept of the subject in general. This section reviews the most-Nasafi of the relevant verses are explained in general. In the seventh chapter dealt with issues related to legal liabilities and commentators about the review of the relevant verses are mentioned. The eighth chapter is given to criminal law reviews. In this section, besides the general principles regarding criminal penalties on special drink, adultery, kazf, sirkat, missus verses such as reviews, with short sentences and punishment ta'z reviews about the verses are mentioned. Ninth reasoning to the department that issues of law and witness testimony sought in the general and special terms, and sworn testimony of witnesses from the rotation reviews have quoted verses dealing with issues. The law of the state in the tenth chapter we work in three parts. In the first part of the essential qualities of the Muslim rulers, in the second part of fundamental rights, in the third section of the law of war verses about issues by identifying the most-Nasafi's reviews have transferred. On the first section we try to explain the above issues about different topics outside commentators have given the reviews.
