Özet
Toplumun temel taşı hüviyetindeki aile, her hukuk sisteminde olduğu gibi İslâm hukukunda da önemli bir yere sahiptir. Ülkemizde Medenî Hukuk'un kabulüyle birlikte evlilik akdinin kuruluşuyla ilgili özel şekil şartları belirlenmiştir. Bu durum toplum içerisinde farklı nikâh şekilleri doğurmuştur. Bu sebeple, evlilik akdinin şartları açısından İslâm Hukuku ve Mer'i Hukuk arasındaki en önemli ayrım noktalarını ve insanları imam nikâhına yönelten psikolojik etmenlerin analizini yapmaya çalıştık. Boşanmanın tescili bölümünde, talâk hakkının kayıtsız şartsız kocaya ait olduğu görüşünün, Kur'an'da yer alan hükümlere dayalı olmadığını belirttik. Kur'an'ın boşanma işlemlerinin belirli usul ve esasların yerine getirildiği bir süreç içerisinde yapılması talebinin tavsiye niteliğinde kabul edilmesi, içerisinden çıkılması güç problemlerin kaynağı haline gelmiştir. Bu sebeple boşanmaların Kur'an'ın belirlediği süreç içersinde tarafların iradelerin de dikkate alındığı usulde gerçekleşmesinin toplumsal maslahata daha uygun olacağını izah ettik.

Purpose of this study is to analyze structural changes in the civil contract with Positive Law at the point of building a family that is cornerstone of the society and to find out the reasons that lead people to imam marriage. With the article prepared for this purpose we have found out that the biggest difference between the Islamic Law and the Positive Law are witnessing and parental permission.We have stated that the most important physchological reasons that lead people to imam marriage are accepting the formal marriage inadequate from the point of Islamic Law, keeping off the legal responsibilities of marriage, having a nice engagement period and the idea of getting married more than once. The divorce's registration shows the Qur'an's position with regard to divorce and explains its nature. Within this context, the opinion of orthodox jurists, that the right to divorce belongs to the man unconditionally, is shown to be based on foundations other than those of the Qur'an. Qur'an divorce proceedings fulfillment of certain principles and procedures performed within a process of acceptance of the request for advisory, in which the source of the problem has become difficult to quit. For this reason, determined by the divorce process within the Quran also taken into consideration the will of the parties that the procedure would be more appropriate to the realization of the social affair've explained.
