The claim of this dissertation is that the TRIPS Agreement has failed to secure the economic development of the developing nations, while protecting the rights of patent holders. This work is divided into five chapters. The first chapter provides an introduction to the topic, and discusses the importance of intellectual property rights protection, in promoting the economic development of the member nations of the WTO, with a special focus on the developing countries. The objectives of the TRIPS Agreement have been analysed and an introduction to its implementation and some of its important provisions, pertinent to our topic have been examined. The second chapter deals with the relationship between intellectual property rights and economic development. In this regard, foreign direct investment and its effect on developing countries have been scrutinised. Furthermore, some important factors considered detrimental to economic development have been analysed. The third chapter deals with intellectual property law in the context of developing countries. In this regard, commitments by the developing countries, which are detrimental to their development have been examined. The fourth chapter addresses the conflict between the developed and developing nations, arising from the regulations of the TRIPS Agreement. The final chapter deals with the conclusions derived from the findings of this work. This work establishes that the provisions of the Trips Agreement do not promote the welfare and economic development of the developing nations. Instead it promotes the rights of patent holders.
