The dependency on technology has been dramatically increased in the last two decades. It has structured a new domain where both governmental and civilian possessions have become vulnerable against serious cyber threats, especially in parallel with the intensive computerisation. A substantial part of national infrastructures, most particularly communication means, national health care systems, and commercial affairs, have begun to be threatened by this intimidation. As a result of the paradigm shift, the understanding of traditional threats has started to transform and the recent international law discussions have taken into account the legal consideration of cyber operations. In these discussions, the main question is how this new reality should be legally treated. In this sense, the two divergent legal approaches has competed in this realm. On the one hand, it is approached the current international law should also apply to cyber conflicts like any other conflicts by analogy in order to avoid a lawless situation; On the other hand, it is adopted that creating a cyberspecific regulation is compulsory because of the insufficiency and inconsistency of the existing law. This study revisits the stated discussion specifically from the point of international humanitarian law. In this context, the key issues that sovereignty, threshold, principle of distinction, neutrality, and attribution are discussed specifically. The author does not technically recognize any obstacle against the applicability of the current IHL regulations, yet they are not clear and sufficient enough to include potential circumstances during cyber warfare. Therefore, the current regulations should be reviewed and enhanced by a broad participation of the international community. The study aims at illustrating the necessity of a new solution bridging the two fundamental approaches by focusing on how the existing legal rules can be partly translated into cyber warfare and why the some of them need to be improved within a new cyber-specific regulation.
