This independent legal research aims to analyse the period of formation, development and change of the United Kingdom and Turkish legal materials throughout the analysis, respective acts of legislations. At the end of this paper focuses and evaluates challenges of the FIDIC red book dispute resolution due to popularity is increasing day by day. The construction industry is one of the most important sector of economy. It can be said that the construction industry is different from the other industries in term of production organisation and contract with various projects. As the construction works various activities and complex structures with different foreign professional group work together. However well prepared contract may not include the whole possibilities especially negative conditions that could damage the project while building. In this step dispute may arise between the project partners. Unless solved quickly, disputes could increase and affect the whole project. Dispute resolution techniques in construction contract can be divide into two groups as formal dispute resolution techniques and alternative dispute resolution techniques. In the scope of this thesis, for litigation and mainly arbitration and for alternative dispute resolution techniques negotiation mediation and dispute review boards are mentioned. However, in a contract alternative dispute resolution techniques the decision taken by formal resolution techniques are binding upon the project participants. Dispute resolutions main aim is solving the problem however alternative dispute resolution techniques solve faster and more economically than formal techniques, but in this thesis focuses on arbitration awards which means arbitrators decisions are binding or not, valid or void. Due to complexity structure of the international commercial law and the trading relations standard contracts become a guide. FIDIC is a standard contract that uses frequently among the construction industry.
