Depositaries are novel improvements in the financial sector; the Alternative Investment Fund Managers Directive Regulation and Undertakings for Collective Investments in Transferable Securities V Directive carefully outline a depositary's liability. The law provides the conditions of the depositary's duty and prescribes applicable limitations. An agreement between a depositary and an investor can facilitate the outsourcing of services on general grounds, such that they can avoid strict legal requirements. Therefore, a depositaries' agreement with their sub-custodians does not necessarily establish the best interests of the investor, or of the law. The Eckerle and Credit Suisse case clearly shows that the investor is placed in the least favourable position. The law emphasises the segregation of the client's account; however, an examination of Barclays Bank PLC show that the segregation requirement is not used effectively by depositaries. Nevertheless, the law has made significant progress in the protection of investors, though their defenceless position continues in many areas.
