Özet

ÖZET Tez, İbn Rüşd'ün hukuki yönünü, özellikle onun“Bidayetü'l-Müctehid ve Nihayetti' l-Muktesıd”adlı eserinden hareketle ortaya koymayı amaçlayan bir çalışmadır. Giriş, iki bölüm ve sonuç kısımlarından oluşmaktadır. Giriş bölümünde İbn Rüşd'ün yaşadığı siyasi ve ilmi çevre ile onun hayatı ve eserleri üzerinde durulmuştur. Birinci bölümde, İbn Rüşd'ün Hukuki metodu ve görüşleri, onun Bidayetü'l- Müctehid ile Muhtasaru'l-Mustasfa adlı eserinden faydalanılarak incelenmiş, gerek hukuki tercihleri, gerekse kendine has yorumları, tespit edilmeye çalışılmıştır. İkinci Bölüm, İbn Rüşd'ün Bidayetü'l-Müctehid adlı eserinin tahlilini içermektedir. Eserin bir ihtilaf kitabı olmasından dolayı, ihtilaf kitapları ve Bidayetü'l- Müctehid'in bu kitaplar içerisindeki konumu ve önemi üzerinde de durulmuştur. İkinci bölüm, eserin kaynakları hakkında verilen bilgilerle tamamlanmaktadır. Seksen yedi sayfadan oluşan tez, genel bir değerlendirmenin yapıldığı sonuç bölümünün ardından, bibliyografya ile bitmektedir.

Özet (Çeviri)

ABSTRACT Thesis is a study aimed to establish the legal aspects of Ibn Rusd, particularly based on the sources his book titled“Bidayetu'l-Muctehid”' It comprises of a preface and two sections. In the introductory section, his brief life story and general aspects of his works have been discussed. Here it is pointed out how the factors and as well as his environment and his teachers influence a scientist and contribute him to form the ideas. First section emphasises on the law making of Ibn Rüsd. Thesis whichrefers to the works of Ibn Rüsdrelating to Islamic Law inlcudes throughly examination of his importance and influence for the science of law. His opinions and preferences concerning law have been put forwart in some parts by using the references from his book“Muhtasaru'l-Mustasfa”and purely reflects his thoughts and choices which originate from“Bidayetu'l-Muctehid”. It noted in this section that he has opted out his views other than those of Maliki sect and his own komments to indicate his opinions Second section completely comprises of an analysis of his book“Bidayetju'l- Muctehid”. As this book has been regarded a book of arguments, general information has been provided on the books of arguments and“Bidayetu'l-Muctehid”is examined in this context.The methods and analysis of“Bidayetu'l-Muctehid”have been discussed and nature formation of the book has been examined. Thesis which consists of eighty seven pages ends with a general discussion
