Özet
Bu tez, bir giriş ve üç bölümden oluşmaktadır. Girişte tezin önemi, amacı, konunun kapsamı ve sunumu ele alınmıştır. Birinci bölümde, nikâhın tanımı, hükmü, nikâh akdinin unsur ve şartları, kefâet, kefâetin hükmü ve mezheplerin kefâetle ilgili görüşleri ve kefâetin olmaması durumunda oluşacak hukuki sonuçlar açıklamaya çalışılmıştır. İkinci bölümde, evlilik sonrasında ailenin devamlılığını sağlayan hukuki unsurlar; nafaka, çocuğu emzirme, cinsi ihtiyacı karşılama gibi eşlerin karşılıklı olarak birbirine karşı görev ve sorumlulukları, birbirlerinin ailelerine karşı görev ve sorumlulukları, evlilikte ileri sürülen şartlar, riayet edilmesi gereken ve gerekmeyen şartlar, eşlerin birbirlerine karşı itaatleri, nüşuz ve şikâk kavramlarından sonra eşlerin konu ile ilgili anlaşmazlıklarda hakeme gitmesi gibi konular hakkında bilgi verilmiştir. Üçüncü bölümde, evlilik sonrasında ailenin devamlılığını sağlayan ahlaki ve manevi unsurlar; karı-koca arasında rahmet ve meveddet, ahlaki ve manevi değerler, eşlerin birbirine verdiği sıkıntıya sabır göstermek, eşlerin birbirlerini Allah için sevmeleri, manevi değerlere inanan insanların ebedi âlemde de bir araya gelebilecekleri, sadakat, vefakâr, fedakâr vb. konular sunulmuştur.
Özet (Çeviri)
This thesis consists of an introduction part and three chapters. In the introduction part, the significance and purposes of the thesis, the scope and presentation of the content have been discussed. In the first section, the definition and provision of the marriage, the condition and component of marriage contract, indemnification and its condition, the views of denominations on indemnification issue and the legal results related to the absence of redemption have been tried to explained. In the second part the information related to the legal elements ensuring continuity of the family after marriage, the mutual responsibilities and duties of the spouses such as alimony, breastfeeding of the baby, supplying the needs, their responsibilities and duties towards their parents, the terms and conditions putting forward during the marriage, the conditions which they should conform to or not to, the mutual obedience of the spouses, and the way the partners proceed incase of disagreement on disobeying and dissesion of the wife towards her husband have been given in accordance with Islamic law. In the third part, the moral and spiritual elements such as mercy and love between husband and wife, moral and spiritual values, showing patience for the troubles that the couples created for each other, loving each other for the sake of God, gathering of people believing in moral issues in the eternal life, loyality,faithfullness,self sacrifice ensuring the continuity of the family after marriage have been presented.
