Özet
İlmî bir kişiliğe sahip olan Zemahşerî, kendisinden sonrakileri etkilemeyi başarmış, nadir şahsiyetlerdendir. Arap diline olan hâkimiyeti sayesinde Kur'ân'ı anlayabilme ve tefsir edebilme noktasında müfessirler arasındaki yerini almıştır. Bu çalışma Zemahşerî'nin (v.748/1321) ahkâm âyetleri açısından el-Keşşâf an Hakaiki Gavamidi't-Tenzil ve Uyuni'l-Akavil fi Vucuhi't-Te'viladlı tefsirindeki görüşlerinin tespiti ve tahlilini içermektedir. Dirâyet metoduna göre yazdığı tefsirinde rivâyetlere de yer veren Zemahşerî, âyetleri dil ve belagat kaideleriyle eski Arap şiirleri ışığında tefsir etmektedir. Müellif ahkâm âyetlerinde daha çok mensubu olduğu Hanefi mezhebine uygun hükümler çıkarmaya çalışmış; diğer mezheplere ait görüşleri de vermeye çalışmıştır. Zemahşerî, eserinde Mutezile mezhebinin ilkelerine uygun olan âyetleri muhkem; aykırı olan âyetleri ise müteşabih saymıştır. Üç bölümden oluşan bu çalışma birinci bölümünde Zemahşerî'nin hayatı, ilmi kişiliği, eserleri ve Mutezili görüşleri hakkında bilgi verilmiştir. İkinci bölümde fıkhî tefsir hareketi, ahkâm âyet sayısı, tasnifi gibi hususlarla ilgili bilgiler verilmiştir. Bu bölünde ahkâm konusu ile ilgili genel bilgi verilerek üçüncü bölümün anlaşılmasına katkı sağlayacağı düşüncesiyle bir hazırlık çalışması yapılmıştır. Üçüncü bölümde ise Zemahşerî'nin taharet, namaz oruç, aile hukuku, savaş, suç ve ceza gibi ahkâma taalluk eden kavram ve konularla ilgili görüş ve yorumlarına yer verilmiştir. Üçüncü bölümde Zemahşerî, ahkâm âyetleri tefsirini dil bilgisine dayalı olarak yaptığı, hüküm ifâde eden âyetlerle ilgili tercihlerini ortaya koyarken başta tabi olduğu Hanefi mezhebi olmak üzere diğer mezhep görüşlerini de tercih ettiği ve kimi yerde ise kendi görüşünü ifâde ettiği görülmüştür. Bu üç bölüm sonunda vardığımız sonuca göre Zemahşerî'nin ahkâma dair tefsiri genelde tabi olduğu Hanefi mezhebine, özelde ise tabi olduğu mutezile mezhebine muvafıktır. Ancak bazı âyetlerin tefsirinde mezhebinin görüşünü tercih etmediği yerler de olmuştur.

Zemahşerî, who is a scientist, is one of the few people who could affect other after his time. He managed to become one of the mufassır by being able to understand and interpret the Qur'an thank to his command of Arabic. This work includes the evaluation and interpretation of Zemahşerî's (d.748/1321) views as represented in his tafseer of verses of ahkâm titled el-Keşşâf an Hakaiki Gavamidi't-Tenzil ve Uyuni'l-Akavil fi Vucuhi't-Te'vilad. Zemahşerî used narratives in his tafseer even though he wrote it using the dirayah method, and interpreted the verses through language and rhetoric in the light of ancient Arabic poetry. He tried to judge the verses of author ahkâm in a way that they would fit the rules of the sect of Hanafi but he also tried to mention the views of other sects. Zemahşerî accepted the verses that fit into the teachings of the Mu'tazilah sect as muhkem and the ones that were contradictory to be mutashabih. The first chapter of this work, which has three chapters in total, provides information about the life, scientific personality, works and the Mu'tazilah views of Zemahşerî. The second section provides information about issues including the movement of fiqh tafseer, the number of ahkâm verses, and their classification. This chapter also provides general information about the subject of ahkâm written as a preparative section in the hope of helping the reader better understand the third chapter. The third chapter presents Zemahşerî's views and interpretations about terms and subjects that are dependent of ahkâm which include purity, prayer, fasting, domestic relations, war, crime and punishment. It was seen in the third chapter that Zemahşerî interpreted the ahkâm verses based on grammar, and when he presented his preferences about the verses that expressed judgments, he preferred the views of all the sects although giving priority to the Hanafi sect, and at some parts he presented his own views. Based on the conclusion we reached following these three chapters, Zemahşerî's tafseer on ahkâm fits into the teachings of the Hanafi sect in general and into the teachings of the Mu'tazilah sect in a more specific way, which are both sects of which he is a member of. However, when interpreting some of the verses he did not prefer the views of these sects as seen in some parts.
