ABSTRACT“ DIVORCE IN THE ARAB TRADITION AND ISLAMIC LAW ”M. A. Thesis, Submitted to the Institute of Social Sciences of Ankara University. Presenter : Ahmet ÜNSAL Superviser :İbrahim ÇALIŞKAN, Professor of Islamic Law at Theology Faculty. Did Islam confirm some traditions ? If confirmed, what sort of traditions were confirmed? And do these traditions tie the whole ummah ? In our thesis we tried to get answers to these questions. It is true that Islam confirmed some Arab traditions. But its unlikely to claim that Islam confirmed them because they rooted in the community. Islam confirmed them because they were in conformity with Islam's doctrine, not because it was not able to overcome the problems overhelmed it. Contrary to that it rooted out some traditions in the Arab community. That Islam used similar terminology as was used in the Arab community doesn't imply that it inherited the whole content from that tradition. Quite a few terms remained as they were, but their content completely changed. It is true that Islam changed people's point of view about women. The clear indicator of this is that it protected women's rights. It counted down those who are forbidden to marry; reduced the number of women to be married to four. The ultimate goal of Islam in this subject was likely to fix the number as one. It accepted one of the ten marriage forms prevalent in the Arab community and forbade the others. It transformed the marriage settlement from worth of woman to the right special to the woman. It counted woman as an inheritor and laid out all share holders. It limited the number of divorce to the three; laid out many cautions to prevent easily divorcing; gave right of divorcing, also, to the woman. Islam made it easy to divorce by the request of woman ( hul' ), while forbidding îla ( vowing ) and zıhâr. Islam fixed divorce times ( i.e.the space of time within which a woman may not remarry ) and by doing that it prevented geneological problems while leaving the divorced family's child to the mother, it gave the fiscal responsibility to the father. t*«HSBS**
