Current developments in international trade gave rise to an increase in transnational litigation. Parties who wish to achieve the most optimal outcome are inclined to forum shop and such an inclination gave rise to the risk of parallel actions. In addition to that, the general desire of the parties of an international commercial litigation is to remove the ambiguity concerning the determination of the competent court that has the authority to resolve the dispute. By virtue of the principal of party autonomy, the parties have been given the opportunity to choose the competent court, as they deem appropriate. However, such autonomy in the designation of the competent court does not always entirely remove jurisdictional conflicts. Common law jurisdictions use discretionary mechanisms such as anti-suit injunctions and forum non conveniens to preclude the risk of conflicting actions. On the contrary, civil law countries, particularly the EU jurisdictional regime, have adopted strict mechanical rules to prevent parallel actions. For this regard, this paper will concentrate on the effects of a jurisdiction agreement in granting a stay to court proceedings on grounds of lis pendens. In brief, this study will primarily analyse the principle of lis pendens and its application amongst the Brussels regime, common law and Turkish law. Thereafter, the choice-of-court agreements and their scope of application in different jurisdictions will be thoroughly examined and lastly by determining the competing situations arising out of the relationship between jurisdiction agreements and parallel actions, possible problematic scenarios and solution proposals will tried to be presented.
