Özet
Özel belgelerden bazıları ticari ve günlük hayatta önemli bir yere sahiptir. Bu sebeple kanun koyucu tarafından bu belgelerin resmi belge hükmünde olduğu TCK m. 210/1'de düzenlenmiştir. Bu maddede sayılan belgelerde işlenen sahteciliğe TCK m. 204/1'de yer alan resmi belgede sahtecilik suçu uygulanacağı belirtilmiştir. Bu çalışmada TCK m. 210/1'de yer alan resmi belge hükmünde belgelerde sahtecilik suçu incelenmektedir. Bu çalışmanın birinci bölümünde ilk olarak belge kavramına ilişkin temel hususlar, resmi belge hükmünde belgelerin çeşitleri, bu belgelerin taşıması gereken zorunlu unsurlar ve benzer suçlardan farkı Yargıtay kararlarından yararlanılarak incelenmiştir. Ayrıca yabancı ülke ceza kanunlarında belgede sahtecilik suçlarına kısaca yer verilmiştir. İlk bölümde öncelikle, bir yazının hangi unsurları taşıması durumunda TCK'ye göre belge niteliğini taşıyacağı ve resmi belge hükmünde belgelerin taşıması gereken zorunlu unsurlar incelenmiştir. İkinci bölümde, bu suçun unsurları, özel görünüş biçimleri Yargıtay kararlarından yararlanılarak teorik ve pratik olarak incelenmiş, bu suça ilişkin soruşturma ve kovuşturma anlatılmıştır.

Some of the special documents take an important place in commercial and daily life. For this reason, it is regulated by the legislator in the TCC article. 210/1 where these documents are presumed to be the official documents. It is stated that the forgery committed in the documents enumerated in this article will be subject to forgery of the official document stated in article 204/1 of the Turkish Criminal Code. In this study, the crime of forgery is examined in the documents which are presumed to be official document in TCC art. 210/1. In the first part of this study, firstly, the basic issues related to the concept of document, the types of documents in the form of official documents, the obligatory elements of these documents and the difference from similar crimes are examined by using the decisions of the court of cassation. Also, forgery crimes in foreign country criminal laws are briefly mentioned in the study. The elements which a writing will carry as a document according to the TCC and the required elements of the documents which are presumed to be the form of official documents are also examined in this part. In the second part, the elements of this crime and their special forms are examined theoretically and practically by using the decisions of the Court of Cassation and the investigation and prosecution of this crime are explained.
