Özet
Avukatlık sözleşmesinde iş sahibinin en önemli borcu ücret ödeme borcudur. Avukatlık Kanunu'nda avukatlık ücreti, avukatın hukuki yardımının karşılığı olan meblağ veya değerdir. Avukatlık sözleşmesi karşılıklı borç doğuran bir sözleşmedir. Avukatlık sözleşmesi bakımından hem avukatı hem müvekkili koruyucu hükümler getirilmiştir. Dolayısıyla Avukatlık Kanunu, kira hukuku, iş hukuku gibi daha ziyade sözleşmenin bir tarafını koruyucu hükümler getirmeyip her iki tarafın da çıkarlarını ortak bir noktada buluşturmaktadır. Avukatlık sözleşmesinde müvekkil, avukatın hukuki yardımı karşılığında ücret ödeme borcu altına girmektedir. Avukatın ücret alacağını tahsil edememesi avukatlık sözleşmesindeki en önemli uyuşmazlık konularından biridir. Bu nedenle çalışma konusu olarak avukatlık sözleşmesinde ücret ele alınmıştır. Avukatlık sözleşmesi içerisinde ücret hususunda bağımsız ve güncel çalışmanın azlığı nedeniyle, son yargı kararları da dikkate alınarak bu çalışma hazırlanmıştır.

Attorney's fee is the most important due of the client in attorney agreement. Attorney's fee is defined in the Attorneys' Act as the amount or the value for the attorney's legal support. Attorney agreement is a mutually debt-arising agreement. Orders that protect both the attorney and the client are set with regards to attorney agreement. So an attorney agreement formed according to the Attorneys' Act reconciles the both sides' of the agreement in common ground not like the rental agreements or labour law agreements that look after just one side's benefits. Client in attorney agreement incur the debt of paying the attorney's fee in return for the attorney's legal support. Attorney's not getting paid the fee is the one of the most important matter of disputes. Most of the disputes arise from the adverse verdicts of the local courts to the minimum attorney fee tariff. Thereby, eliminating the lack of knowledge about the attorney's fee within the Attorneys' Act and the minimum attorney fee tariff is crucial. Hence, the fee in the attorney agreement is addressed as working item. Because of the scarcity of independent and up-to-date study about the fee in the attorney agreement, this study is written in the light of the last judicial decisions.
