This thesis main aim is to critically analyze Turkish commercial cases under ICSID and ICC arbitration rules and evaluate under investment law which rule is more favourable to Turkey. Further, it will briefly outline the Turkey's international arbitration law and investment law taking into an historical and contemporary approach. Moreover, this thesis focus on the importance of distinctive features of ICSID rules in providing investment rules for Turkey. It would be stated preconditions to apply ICSID arbitration rules and legal framework of ICSID and ICC rule further, it evaluates the mean of investor and investment under ICSID rules. In addition, it would be stated bilateral investment traties and importance of investment. The emphasis will also be placed essential protections under ICSID like the MFN, FET and expropriation without compensation. This work elaborates also consent of arbitration under both rules. This present work extensively reviewes the importance of the main differences in the process of ICC and ICSID arbitration for Turkey. Moreover, the focus will be placed applicable law and local court authority under ICC and ICSID rules. This work compares and contrasts these rules in terms of selection of arbitrators, jurisdiction, confidentiality and transparency, publication of awards, costs and attorne's fees. In addition, this work gave emphasis to challange mechanism under ICC and ICSID arbitral proceeding. In suggestion, this work evaluates which rules overcomes in enforcement and annulment mechanism . This work valuates application of public policy in Turkey when enforcing ICC awards . Lastly, this work give advantages and disadvantages of ICC and ICSID rules and appreciates which rule is more favourable to Turkey in investment arbitration in terms of providing confident and investor-friendly environment. To sum up, the concluding remarks have been provided at the end of this work
