This thesis demonstrates the boundaries of the margin of appreciation granted to the Member States of the Council of Europe under Article 1 of Protocol No 1 of the European Convention on Human Rights, through the case-laws of the European Court of Human Rights in the spatial planning and expropriation cases. The thesis examines the history of the Convention and draft history of Article 1 of Protocol No 1 since the right to property does not take place in the principal text of the Convention. It was annexed to the Convention with Article 1 of Protocol 1. In the drafting process of the article, the supervision of an international court over national matters such as nationalisation of private properties and the right itself were debatable issues. However, the Court developed interpretation principles in order to make clear the provisions of the Convention since the circumstances have been changing over the time which the Convention was signed. The margin of appreciation is a concept developed by the Court to arrange the relationship between the national authorities and the Court as the Court approves that its role is subsidiary and that the national authorities are principally better placed to evaluate human rights issues. However, the margin of appreciation granted to the States changes in the application of each article of the Convention. In fact, the States enjoy very wide margin of appreciation under Article 1 of Protocol No 1, especially, the cases regarding to the town planning, nationalisation or expropriation and regional planning concerning environmental protection. As a result, the thesis aims to highlight a better understanding of the boundaries of the margin of appreciation under the article in the spatial planning and expropriation case-laws of the Court.
