Özet

Kişisel Verileri Koruma Kurumu, 2016 yılında yayımlanan 6698 sayılı kişisel Verileri Koruma Kanunu ile kurulmuş bir kurumdur. Kurum, Avrupa Birliği'ne uyum süreci kapsamında, kişisel verilerin korunması noktasında gerekli denetimi ve düzenlemeyi sağlayıcı bir otorite olarak kurulmuştur. Bu noktada da kendisine idari ve mali özerklik sağlanmıştır. Kurum'un esas amacı yaygınlaşan teknolojik gelişmelerle beraber gerçek kişilere ait kişisel verilerin kötü amaçlarla kullanılmasını engellemek, kişilerin yaşanacak ihlaller nedeniyle temel hak ve özgürlüklerine gelecek zararları engellemek ve veri sorumlularına bu tip ihlallerin yaşanmaması için neler yapmaları gerektiğini göstermektir. Bu sebeple de Kurum'un düzenleme ve denetleme yetkisi bulunmaktadır. Böylece önleyici düzenlemeler ve ihlal hallerinde yaptırım uygulama yetkisi bulunmaktadır. Bu doğrultuda Kişisel Verileri Koruma Kurumu'nun idari teşkilatımızdaki yeri, kendisine sağlanan tarafsız ve bağımsızlık niteliğinin kurumun çalışma esasları doğrultusunda değerlendirilmesi yapılmaya çalışılmıştır.

The Personal Data Protection Authority is an institution established by the Law on the Protection of Personal Data No. 6698 published in 2016. The Authority was established as an authority to provide the necessary supervision and regulation for the protection of personal data within the scope of the harmonization process with the European Union. At this point, it was granted administrative and financial autonomy. The main purpose of the Authority is to prevent the misuse of personal data belonging to real persons with the widespread technological developments, to prevent damages to the fundamental rights and freedoms of individuals due to the violations to be experienced and to show the data officers what they should do to prevent such violations. Therefore, the Authority has the authority to regulate and supervise. Thus, it has the authority to apply sanctions in case of preventive arrangements and violations. In this respect, the position of the Personal Data Protection Authority in our administrative organization and the objective and independence quality provided to it are evaluated in accordance with the working principles of the institution.
