Özet
Örgütlü suçlulukla mücadelede, klasik koruma tedbirlerinin yanı sıra kimi zaman modern koruma tedbirlerinin dahi çaresiz kalması; suç ortamına girilerek, suçun daha yakından soruşturulması mecburiyetini doğurmuştur. Bu noktada ise görevlendirildiği örgütün iç kısmına sızabilecek bir gizli soruşturmacının, maddi gerçeğe ulaşılması açısından vazgeçilmez bir araç olduğu anlaşılmıştır. Nitekim, görevlendirildiği örgüt hakkında her türlü araştırmada bulunan ve görevini, muhataplarının bilgisi haricinde yürüten gizli soruşturmacının, suç delillerine ulaşılabilmesi ve faillerin tespit edilebilmesi bakımından son derece etkili ve elverişli olduğu açıktır. Buna karşın, bir yönüyle suçların aydınlatılmasına hizmet eden, diğer yönüyle ise hak ve özgürlüklere müdahalede bulunan gizli soruşturmacının, tartışmalara yol açması da kaçınılmaz olmuştur. Bu bağlamda, özellikle gizli soruşturmacının; diğer koruma tedbirlerine re'sen başvurabilmesi, konuta girebilmesi ve suç işleyebilmesi tartışma konusu olmuştur.

In the fight against organized crime, besides the classical protection measures, sometimes even modern protection measures have been helpless. As a result, it became necessary to investigate the crime more closely by entering the crime environment. At this point, it has been understood that a secret investigator, who can infiltrate the inner part of the organization he is assigned to, is an indispensable tool in terms of reaching the material truth. As a matter of fact, it is clear that the undercover investigator, who conducts all kinds of research about the organization he is assigned to and carries out his duties without the knowledge of his interlocutors, is quite effective and convenient in terms of accessing crime evidence and identifying the perpetrators. On the other hand, it was inevitable that the secret investigator, who served to illuminate the crimes on one side and interfered with the rights and freedoms on the other side, led to discussions. The topics discussed in this context are especially; It is the ability of the undercover investigator to apply for other protection measures by himself, to enter the residence and to commit a crime.
