Özet
Bu çalışmamızda, Zahiri Mezhebi'nin ikinci kurucusu olarak kabul edilen Endülüslü fakih İbn Hazm'ın telif etmiş olduğu Mukayeseli İslam Hukuku olarak bilinen el-Muhallâ adlı eserinde Ceza Hukukuyla ilgili konularda İmam Şâfiî'ye nispet edilen görüşlerin isabetli olup olmadıklarının araştırılması amaçlanmıştır. Eserin mukayeseli hukuk türünden yazılmış olması ve bu tür eserlerde ihtiva eden karşıt görüşlerde hataların bulunması bizi araştırmaya sevk etmiştir. Çalışmamız bir giriş ve iki bölümden oluşmaktadır. Giriş kısmını araştırmamızın konusu, amacı ve önemi, metodu ve kaynakları oluşturmaktadır. Çalışmamızın birinci bölümünde eserin müellifi olan İbn Hazm'ın hayatı, hocaları, talebeleri, ilmî hayatı, fıkhî metodu ve had cezaları ile ilgili görüşlerine yer verilmiştir. Ayrıca telif etmiş olduğu eserleri hakkında kısa bilgi ve çalışmamızın asıl konusu olan el-Muhallâ adlı eseri hakkında da detaylı bilgi verilmiştir. Çalışmamızın ikinci bölümünde ise İbn Hazm'ın el-Muhallâ adlı eserinde Ceza Hukukuyla ilgili konularda İmam Şâfiî'ye nispet etmiş olduğu görüşlerin isabetli olup olmadığı ve hatalı olarak nispet edilen görüşlerin de doğru olanı Şâfiî mezhebinin temel kaynaklarına müracaatla tespit edilmeye çalışılmıştır. Çalışmamız sadece İmam Şâfiî ve Şâfi mezhebine nispet edilen görüşlerin incelemesi üzerine olduğundan İbn Hazm'ın diğer mezhep imamlarına nispet ettiği görüşler bu çalışma dahilinde değildir. İbn Hazm'ın el-Muhallâ adlı eserinde İmam Şâfiî'ye ceza hukuku bağlamında 113 görüşün atfedildiği tespit edilmiştir. Şâfiî mezhebinin temel kaynaklarına müracaat edilerek yapılan incelemer sonucunda nispet edilen 113 görüşten 107 görüşün isabetli 6 görüşün de hatalı olduğunu görülmüştür. Hatalı olan görüşler ise kısas (1), diyet (2), diyetin çeşitleri (2) ve zina (1) bahislerinde yer almaktadır. Çalışmamızın sonuç kısmına elde edilen önemli bulgular derlenmiş, ayrıca değerlendirilmesi kolaylık olsun tespit edilen hatalar sıralanmış ve doğru olan karşılıkları da verilmiştir.

In this thesis, it is aimed to examine the opinions attributed to Imam Shafii in matters related to Criminal Law in the work known as Comparative Islamic Law, which was written by Andalusian faqih Ibn Hazm, who is well known in both the Muslim and Western world, who is accepted as the second founder of the Zahiri madhabs. It is aimed to investigate whether they are correct or not. The fact that the work was written in the form of comparative law and there were errors in the opposing views contained in such works directed us to this research. The thesis is split up into two parts: The introduction part consists of the subject, purpose and importance, method and resources of our research. In the first part of our study, the views of Ibn Hazm, the author of the work, about his life, teachers, students, scientific life, jurisprudence method and hadd punishments are given. In addition, brief information about his copyrighted works and detailed information about his work named al-Muhallâ, which is the main subject of our study, is given. In the second part of our study, it has been tried to determine whether the views that Ibn Hazm attributed to Imam Shafii in his work al-Muhallâ on the issues related to Criminal Law are correct or not, and the correct one of the views attributed to him as wrong, by applying to the basic sources of the Shafi'i sect. Since our study is only about examining the views attributed to Imam Shafii and Shafi'i madhabs, the views that Ibn Hazm ascribes to other madhab imams are not included in this study. We have determined that 113 opinions are attributed to Imam Shafii in the context of criminal law in Ibn Hazm's book al-Muhalla. As a result of the examination made by referring to the main sources of the Shafi'i sect, we determined that 107 opinions out of 113 opinions were correct and 6 opinions were wrong. The wrong opinions are in the bets of retaliation (1), diet (2), types of diet (2) and adultery (1). Evaluation of the errors detected in the conclusion part of our study is presented separately for convenience.
