One of the most controversial subjects in the scope of the international economy over the last few years has been Sovereign Wealth Funds (SWFs). A large proportion of SWFs has been established by Asian and Middle Eastern countries, and their largest investments are made in developed Western countries. States are included in the financial markets as direct players through SWFs, therefore new areas of controversy have arisen among recipient states and possessing states. However, SWFs are being used as political instruments rather than for economic purposes, and this has caused concerns and dangers to national security. Also, the complex structures of SWFs and their being unregulated have increased concerns about them. Accordingly, states have made restrictive and protectionist measures in domestic law against SWFs investing in their country. SWFs and possessing states initiated working together because of the need for international regulation under formal economical institutions such as the International Monetary Fund (IMF) and the Organisation for Economic Cooperation and Development (OECD), and the principles for SWFs and for recipient countries were formed. However, these principles could not respond to the requirements because of their nature of being nonbinding and unenforceable. Also, the proposals offered either partial or short-term solutions. The conclusion of this paper is that a study into the preparation of comprehensive, binding and enforceable regulations at international level should be commenced with the broad participation of developed Western countries as recipient countries and the possessing states of SWFs. Also, an institution should be formed under the new regulations to follow up on the implementation of provisions by the parties involved. The new regulations should also provide a centre of arbitration for the settlement of disputes between parties. A similar roadmap to the Santiago Principles might be followed during the regulation process
