Third-party funding has been hotly debated in the field of international investment arbitration since the practice was firstpermitted in major common law and civil law jurisdictions. Developments in these funding arrangements have, however, brought various issues to the fore.Two issues in need of urgent attention are the disclosure of third-party funding and security for costs.The International Centre for Settlement of Investment Disputes (ICSID) which has hosted more than ninety per cent of international investment cases does not currently regulate these.In this dissertation, I explore the history of third-party funding, its place in international arbitration, and its advantages and disadvantages. I then address situations in which an arbitrator may face a conflict of interest the need for regulation for the disclosure of third-party funding. I suggest that disclosure of third-party funding should be regulated. The fundamental concept of security for costs is then addressed and a proposal made that arbitral tribunals should take third-party funding into account when deciding security for costs orders. I propose specific changes concerning the ICSID's proposed arbitration rule on security for cost orders, and suggest that a new rule be established that allows arbitral tribunals to render cost awards against third-party funders.
