Özet

Arsa payı karşılığı inşaat sözleşmesi, arsa sahibi ve yükleniciye asli edim yükümlülüğü getirmektedir. Yüklenicinin vadesinde inşaatı tamamlayarak arsa sahibine teslim etmemesi temerrüdüne neden olmakta, arsa sahibi yüklenicinin temerrüdü nedeniyle sözleşmeyi sona erdirmektedir. Arsa sahibinin yüklenicinin teslimde gecikmesine bağlı olarak sözleşmeden dönmesi halinde arsa sahibi ile yüklenici arasında bir kısım problemler gündeme gelmektedir. Arsa sahibinin sözleşmeden dönmesi halinde henüz inşaat başlamadan veya inşaat aşamasında yükleniciye devir edilmiş olan arsa paylarının ne olacağı hususu tartışmalıdır. Teslimin gerçekleşip gerçekleşmediği dolayısıyla yüklenicinin temerrüde düşmesinin şartlarının oluşup oluşmadığı, temerrüt şartlarının oluşması halinde arsa sahibinin haklarının neler olduğu, arsa sahibi sona ermeye bağlı haklarını kullanırken arsa sahibinin sözleşmeden dönmesi veya sözleşmeyi fesih etmesi halinde hangi durumların ortaya çıkacağı hususu doktrin ve Yargıtay kararları çerçevesinde bu tez çalışmamızda irdelenmeye çalışılmıştır.

Özet (Çeviri)

The construction contract in return for the land share imposes a primary performance obligation on the land owner and the contractor. The contractor's failure to complete the construction on time and deliver it to the land owner causes default, and the land owner terminates the contract due to the contractor's default. In case the land owner reneges from the contract due to the contractor's delay in delivery, some problems arise between the land owner and the contractor. If the land owner reneges from the contract, it should be discussed what will happen to the land shares that have been transferred to the contractor before the construction starts or during the construction phase. In this thesis, within the framework of doctrine and Supreme Court decisions, we will discuss whether the delivery has taken place and therefore the conditions for the contractor to default occur or not, what are the rights of the land owner in case of default conditions, what situations will arise in case the land owner withdraw from contract or terminates the contract while the land owner uses his rights due to termination has been explored.
