The employment of arbitration has been increasing in cases regard to competition law. Considering the increasing use of arbitration in these areas, this dissertation aims to provide a critical analysis to the issue arbitrability of competition law in the European Union and the United States and use of arbitration as a supervision mechanism over mergers in European Community. This study assessed the evolution of the approaches of both the European Union and the United States to the matter whether the disputes arising from competition law are suitable to arbitration and provided a general overview of the increasing use of arbitration in merger commitments. Within this framework, the review of arbitral awards is examined together with the impacts of the modernisation process of the EU to this matter. Moreover, the employment of arbitration to provide supervision on mergers is discussed.
