Özet
Tüm dünyada hızla yayılım gösteren Covid-19 salgını sebebi ile diğer ülkeler gibi ülkemizde de yayılımın engellenmesi amacı ile birtakım tedbirler alınması gerekmiştir. Alınan tedbirlerin bir kısmı ise hak kayıplarının önüne geçilebilmesi amacı ile hukuk sistemimiz için alınmıştır. Ancak ülkemizde salgın gibi olağanüstü durumlarda uygulanacak bir kanun bulunmayışı sebebi ile tedbirlerin bir kısmı kanun yoluyla bir kısmı da genelgeler yoluyla alınmıştır. Bu durum hukuk güvenliği açısından olumsuzluk arz etmekle, insan haklarına ilişkin temel ilkelere de aykırılık teşkil etmektedir. Bu dönemde hem Türk hukuk sisteminde hem de diğer ülkelerin hukuk sistemleri içerisinde adliyelerdeki insan yoğunluğu azaltılmak istenmiştir. Duruşmalar video konferans yöntemi ile gerçekleştirilmiş, acil olan işlerin görülmesine öncelik tanınmıştır. Ülkemizde de sürelerin durdurulması ve duruşmaların ertelenmesi yönünde kararlar alınmıştır. Adliye girişlerine sınırlamalar getirilmiştir. Elektronik sistemler üzerinden işlemlerin yürütülmesi sağlanmış, esnek çalışma sistemine geçilmiştir. Ancak alınan bu tedbirler salgının yayılmasını önlemek amacı ile getirilmişse de birtakım olumsuzlukların oluşmasına da sebebiyet vermiştir. Bu çalışma ile pandeminin Türk Adalet Sistemine ne gibi yansımalarının olduğu hususları araştırılmak istenmiştir. İlk olarak çeşitli hukuk alanlarında uzman avukatlar ile yapılan derinlemesine görüşmeler sonucunda hukuk alanında yaşanan problemlerin neler olduğu tespit edilmiştir. Sonrasında bu çalışmaya dayanılarak hazırlanan anket çalışması ile bu dönemde alınan tedbirlerin yeterli olup olmadığı, yaşanan sorunların neler olduğu, çözümlerin neler olabileceği noktasında avukatlar üzerinden değerlendirmeler yapılmıştır. Bu dönemde elektronik araçların kullanımının fayda sağlamış olduğu belirtilmişse de yargının birimleri tarafından bu araçların etkin kullanılamadığı düşünülmektedir. Ayrıca alınan tedbirlerin salgının yayılmasına engel olduğu yönünde görüşler mevcuttur. Ancak bu tedbirler sebebi ile işlemlerin yerine getirilmesi noktasında gecikmeler yaşanmış olduğu belirtilmiştir. Pandemi döneminde yargı alanında yaşanan sıkıntıların oluşmasındaki en büyük etkenin ise adliyelerin işleyişindeki aksaklıklar olduğu görülmüştür. Adliyelerdeki birimlerle iletişim kurulabilmesi noktasında yeni sistemlerin kurulması ve yargı birimlerinin sistemleri doğru ve etkin kullanılması noktasında adaptasyonunun sağlanması ile işlemlerin süresinde yerine getirilebileceği söylenebilir. Ayrıca alınan bu tedbirlerin kanuni dayanaktan yoksun olması ve işlemlerin yerine getirilmesindeki gecikmeler sebebi ile birtakım hak ihlallerine sebebiyet verebileceği açıktır. Bu sebeple diğer ülkelerde olduğu gibi hukuk sistemimizde de olağanüstü durumlar karşısında uygulama alanı bulabilecek bir çerçeve kanun ihtiyacı bulunmaktadır.

Due to the rapidly spreading Covid-19 epidemic all over the world, some measures had to be taken in order to prevent the spread in our country, as in other countries. Some of the measures have been taken for our legal system in order to prevent loss of rights. However, due to the absence of a law to be applied in extraordinary situations such as epidemics in our country, some of the measures were taken by law and some by circulars. Although this situation is negative in terms of legal security, it also violates the basic principles of human rights. In this period, it was desired to reduce the human density in the courthouses both in the Turkish legal system and in the legal systems of other countries. Hearings were held by videoconferencing and priority was given to seeing urgent matters. In our country, decisions have been taken to suspend the deadlines and postpone the hearings. Restrictions were imposed on courthouse entrances. Transactions were carried out through electronic systems, and a flexible working system was adopted. However, although these measures were taken in order to prevent the spread of the epidemic, they also caused some negativities. With this study, it was aimed to investigate the reflections of the pandemic on the Turkish Justice System. First of all, as a result of in-depth interviews with lawyers who are experts in various fields of law, the problems experienced in the field of law were determined. Afterwards, with the survey study prepared on the basis of this study, evaluations were made on the point of whether the measures taken in this period were sufficient, what the problems were, and what the solutions could be. Although it was stated that the use of electronic tools was beneficial in this period, it is thought that these tools could not be used effectively by the judicial units. In addition, there are opinions that the measures taken prevent the spread of the epidemic. However, it was stated that there were delays in the execution of the transactions due to these measures. It has been seen that the biggest factor in the formation of the problems experienced in the judicial field during the pandemic period is the malfunctions in the functioning of the courthouses. It can be said that the procedures can be carried out in a timely manner by establishing new systems in terms of communicating with the units in the courthouses and ensuring the adaptation of the judicial units to the correct and effective use of the systems. In addition, it is clear that these measures may cause some violations of rights due to the lack of legal basis and delays in the execution of the proceedings. For this reason, as in other countries, there is a need for a framework law that can find application in the face of extraordinary situations in our legal system.
