Although there are established criterion through case law for specific applications of the other protection mechanisms in bilateral investment treaties, there are not constituted set of standards for the application of the umbrella clauses. For instance, there are three main criteria established by case law for the application of the fair and equitable treatment standard:“stability”,“the protection of investor's legitimate expectation”and“transparency of the legal framework”. Yet, there is anything for umbrella clause. The lack of precedent and consensus in customary international law and in treaty practice of umbrella clauses and their hybrid character give rise to several issues and questions: What are the criteria for the application of the umbrella clause? What are the limits of its scope when it is compared to other substantive protections? Do the umbrella clauses automatically convert the contractual claims into the treaty claims; do they elevate the contractual breaches to the level of international treaty breaches; if so, does this conversion change the nature of contractual claims; what happens to the applicable law administering the dispute and do the investment tribunals have jurisdiction over these claims? These are the main themes that will be dealt in this thesis.
