This dissertation aims to address the question whether sales and consumer law regimes across several jurisdictions are applicable to transactions involving software and more broadly“digital materials”. Having adopted a modern approach considering the boost in the trade of various types of digital materials differentiating from software, this work's analysis is not limited to whether software constitutes goods but also whether other forms of digital materials such as electronic books, apps, images, and games fall within the definition of 'goods' under the sales and consumer law regimes. Legislation and case law across several jurisdictions, namely United Kingdom, Australia, New Zealand and European Union in classifying software and digital materials are examined in order to have a better understanding of the legal concept of digital materials and to reach a coherent response to the lack of clarity as to the legal treatment of digital materials. Recent legislative developments in the United Kingdom and the European Union are also examined as contemporary approaches to the issue which other jurisdictions may learn from. Given that traditional legal concepts fail to recognise new products of digital market, it is considered crucially necessary in today's digitalized world that jurisdictions should take into account how transactions of various types of digital materials should be governed and it is suggested that they should not receive a discriminatory treatment when compared to“goods”. This work agrees with the view that outdated approaches as to goods definition should be abandoned and software and all digital materials should be covered within the definition of goods in sales law and consumer law fields
